Senate Sponsors: MAITLAND. House Sponsors: RUTHERFORD-COULSON-GILES Short description: UTIL VEGETATION MANAGEMENT Synopsis of Bill as introduced: Amends the Public Utilities Act. Provides that in conducting non-emergency vegetation management activities in municipalities, electric public utilities shall provide notice of the activities and comply with guidelines established by the International Society of Arboriculture and any applicable standards established by the Occupational Safety and Health Administration and the American National Standards Institute. Requires the Commerce Commission to establish statewide standards for tree-trimming activities performed by public utilities. Effective immediately. SENATE AMENDMENT NO. 1. Provides that the provisions of this amendatory Act do not restrict other civil or administrative remedies available to customers. HOUSE AMENDMENT NO. 1. Provides that the standards for non-emergency vegetation management practices apply in both municipalities and in unincorporated areas of counties. Provides that the most current guidelines promulgated by the International Society of Arboriculture and the most current standards issued by the Occupational Safety and Health Administration or the American National Standards Institute shall be followed. Provides that an electric public utility does not have to comply with the guidelines if there is a written agreement between the utility and a municipality mandating specific practices for vegetation management. Provides that the required notice shall be given to the mayor or county board chairman. Provides that if a municipality imposes more restrictive standards for vegetation management practices, the electric public utility may recover the additional costs from the municipality. Effective immediately.
