House Sponsors: GASH-LINDNER-FRITCHEY-GARRETT-LYONS,EILEEN Short description: VEH CD-TARPS WHILE ON HIGHWAYS Synopsis of Bill as introduced: Amends the Illinois Vehicle Code to prohibit a person from operating a second division vehicle on a highway if (instead of when) certain materials are escaping from the vehicle. Provides that a person in violation of that provision must reduce, cover with a tarpaulin, or otherwise secure (instead of reduce, secure, or cover with a tarpaulin) the escaping material. SENATE AMENDMENT NO. 1. Deletes everything. Provides that no person shall operate a se- cond division vehicle loaded with dirt or garbage unless the material is in a cargo container. Provides that the tailgate on the vehicle must be in good repair to prevent material from escaping. Provides that a police officer may stop a vehicle if a dangerous condition exists where the material may escape from the vehicle. FISCAL NOTE (Illinois State Police) There will be no fiscal impact on the Dpt. of State Police. CORRECTIONAL NOTE (Dept. of Corrections) This legislation would have no fiscal or prison impact on DOC. GOVERNOR'S AMENDATORY VETO MESSAGE Recommends that the bill be amended so that the tailgate require- ment does not apply to pickup trucks.
