House Sponsors: WOJCIK-COWLISHAW-HULTGREN-CAPPARELLI-BLACK Short description: FIRE PROTCT-CONTRACTS Synopsis of Bill as introduced: Amends the Fire Protection District Act in the Section concerning disconnection of territory located in a municipality in which more than 50% of the district's total territory is located. Provides that the court shall hold a hearing not less than 4 weeks nor more than 8 weeks (now, not less than 2 weeks nor more than 4 weeks) after a petition for disconnection is filed. Provides that if the conditions for disconnection are met, the court shall order a referendum on the question of disconnection if a petition requesting a referendum, signed by no fewer than 1% of the registered voters in the district, is filed with the court at or before the required hearing. Provides that if a majority of the voters voting on the question vote in the affirmative, the court shall order the disconnection. Provides that if a majority of the voters voting on the question vote in the negative, the court shall dismiss the petition and no petition seeking disconnection may be filed for a period of 5 years after dismissal. SENATE AMENDMENT NO. 1 Further amends the Fire Protection District Act. Provides that notice of a hearing on a petition for disconnection from a fire pro- tection district must be given 21 days (now 10) before the hearing. HOUSE AMENDMENT NO. 1. (House recedes January 9, 2001) Further amends the Fire Protection District Act. Provides that the changes to the Section concerning the disconnection of territory located in a municipality in which more than 50% of the district's total territory is located do not apply to proceedings for disconnection for which a municipality has filed a petition for disconnection on or before the effective date of the amendatory Act.
