Provides that domestic battery is a Class 3 felony if the defendant causes bodily harm to a family or household member in the presence of a person under 18 years of age. Effective immediately. SENATE AMENDMENT NO. 1. Adds reference to: 730 ILCS 5/5-5-6 from Ch. 38, par. 1005-5-6 Deletes the title and everything after the enacting clause. Amends the Criminal Code of 1961 and the Unified Code of Corrections. Provides that a defendant convicted of domestic battery is liable for the cost of any counseling, at the discretion of the court, required for a child under 18 years of age who is the child of the offender or of the victim if the child was present and witnessed the domestic battery of the victim.
