CRIM CD-DEATH SENTENCE-RACE                                                

Synopsis of Bill as introduced:
        Amends the Criminal Code of 1961 relating to  the  imposition  of      
   the death penalty for first degree murder.  Provides that a person may      
   not be given a sentence of death that was sought on the basis of race.      
   Provides  that  the defendant may raise the question of whether racial      
   considerations were a significant part of the decision by the State to      
   seek the death penalty in his or her case.  Provides for a hearing  on      
   this  issue  if  it  is raised.  Provides that if the court finds that      
   racial considerations were a significant factor in the  State  seeking      
   the  death  penalty,  the  court shall order the State not to seek the      
   death penalty.  Effective immediately.
