House Sponsors: FRITCHEY-FEIGENHOLTZ-LOPEZ-ACEVEDO-DAVIS,MONIQUE. Short description: EXCAVATION-OWNER RESPONSIBLTY Synopsis of Bill as introduced: Amends the Illinois Insurance Code. Provides that a policy of basic property insurance may not exclude coverage for damage to property caused by excavation. Prohibits an insurance company that is authorized to do business in this State and that issues a policy of basic property insurance from failing to issue or renew a policy of basic property insurance if the owner of the property has excavated land on his or her property or if excavation has taken place on the property adjacent to the owner's property. Amends the Adjacent Landowner Excavation Protection Act. Provides that an owner or possessor of land who intends to make or to permit an excavation of the land may not begin excavation until the owner or possessor takes measures to protect a building or other structure on the adjoining land from any damage or in which to extend the foundation of the building or other structure, if the structure is to be of a greater depth than the walls or foundations of the adjoining building or other structure and is to be so close as to endanger the building or other structure. Present law places this responsibility on the owner of the building or other structure on the adjoining land.
