House Sponsors: KENNER. Short description: SUPPORT-GARNISH-INCOME W-HOLDG Synopsis of Bill as introduced: Amends the Code of Civil Procedure and the Income Withholding for Support Act. Provides that moneys owed to an obligor and property owned by an obligor are not subject to garnishment for the purpose of satisfying an order for child support unless a court of competent jurisdiction has found that there is a delinquency under the order for child support. Provides that in the case of an order for child support, an income withholding notice shall direct a payor to withhold income from an obligor only if a court of competent jurisdiction has found that there is a delinquency under the order for child support. Provides that for purposes of garnishment under an order for child support and for purposes of the Income Withholding for Support Act in the case of an order for child support, "moneys owed to" an individual and an individual's "income" do not include any amounts owed or paid to the individual as a per diem or as reimbursement for work-related expenses incurred by the individual. HOUSE AMENDMENT NO. 1. Deletes reference to: 735 ILCS 5/12-704.5 new 750 ILCS 28/20 Deletes the amendatory provisions added to the Code of Civil Procedure and the Income Withholding for Support Act authorizing garnishment and income withholding only when a court has found that there is a delinquency under an order for support.
