CRIM CD-STLKNG-ELECTRNC MEANS                                              

Synopsis of Bill as introduced:
        Amends the Criminal Code of 1961. Includes in the definition of        
   the offense "stalking" placing a person under surveillance through          
   electronic means in conjunction with the threat of immediate or future      
   bodily harm, sexual assault, confinement, or restraint or the reason-       
   able apprehension of immediate or future bodily harm, sexual assault,       
   confinement, or restraint to himself or herself or to a family member.      
   Effective January 1, 2001.

        HOUSE AMENDMENT NO. 1.                                                 
          Deletes reference to:                                                
          720 ILCS 5/12-7.3                                                    
          Adds reference to:                                                   
          720 ILCS 5/12-7.5 new                                                
        Deletes the title  and  everything  after  the  enacting  clause.      
   Amends   the   Criminal   Code   of   1961.  Creates  the  offense  of      
   cyberstalking.  Provides that it is unlawful to knowingly and  without      
   legal justification on at least 2 separate occasions to harass another      
   person  through  the  use  of  electronic communication and transmit a      
   threat  of  immediate  or  future   bodily   harm,   sexual   assault,      
   confinement,  or restraint to the person or the person's family member      
   or  place a  person  or  the  person's  family  member  in  reasonable      
   apprehension  of  immediate  or  future  bodily  harm, sexual assault,      
   confinement, or restraint.  Provides that  the  penalty  for  a  first      
   offense  is a Class 4 felony and for a second or subsequent offense is      
   a Class 3 felony. Adds an immediate effective date to the bill.
