Senate Sponsors: PARKER-LIGHTFORD-OBAMA-MUNOZ-SMITH Short description: MENTAL HEALTH-DECISION MAKER Synopsis of Bill as introduced: Amends the State Employee Indemnification Act, the Mental Health and Developmental Disabilities Code, and the Mental Health and Developmental Disabilities Confidentiality Act. Eliminates certain references to "participating mental health centers", "qualified certifiers", and "community service areas". Grants certain rights to notice to substitute decision makers who have authority under the Powers of Attorney for Health Care Law or under the Mental Health Treatment Preference Declaration Act. Changes the definition of "psychiatrist" for purposes of the Mental Health and Developmental Disabilities Code. Makes numerous changes concerning the rights of recipients of mental health and developmental disabilities services and concerning the admission, transfer, and discharge procedures for the mentally ill. Effective immediately. HOUSE AMENDMENT NO. 1. Adds reference to: 405 ILCS 5/1-114.2 rep. 405 ILCS 5/1-114.3 rep. 405 ILCS 5/1-114.4 rep. 405 ILCS 5/1-114.5 rep. 405 ILCS 5/3-601.1 rep. Further amends the Mental Health and Developmental Disabilities Code. In the definition of "substitute decision maker" added by the bill, deletes the reference to "current" possession of the authority to make decisions. Repeals provisions of the Code concerning definitions of "participating mental health center", "qualified certifier", "community service area", and "service area" and concerning admission to a State-operated mental health facility in a community service area having a participating mental health center. SENATE AMENDMENT NO. 1. In provisions of the Mental Health and Developmental Disabilities Code concerning the time for holding a court hearing with respect to the administration of authorized involuntary treatment, authorizes the court to grant an additional continuance not to exceed 21 days if necessary to conduct a physical or other examination of the recipient of services, to provide the recipient with a trial by jury, or to arrange for substitution of counsel. (Replaces the bill's deletion of authority for additional continuances if agreed to by all parties.)
