Senate Sponsors: BURZYNSKI Short description: OPTOMETRY-FEE SHARING Synopsis of Bill as introduced: Amends the Illinois Optometric Practice Act of 1987. Provides that any individual or entity that influences or attempts to influence patient care decisions of a licensed optometrist under the individual's or entity's control shall pay, in addition to any other penalty provided by law, a civil penalty to the Department in an amount not to exceed $5,000 per offense. Excludes the division of fees between 2 optometrists, an optometrist and a physician licensed to practice medicine in all its branches, or an optometrist and a licensed health care facility in a contractual or employment relationship from the grounds for disciplinary action. Effective immediately. HOUSE AMENDMENT NO. 1. Provides that the patient care decisions that an individual who is not licensed to practice medicine in all of its branches or entity may not influence are diagnostic or treatment decisions. Provides that the unlicensed practice provisions shall not be construed to prohibit insurers and managed care plans from operating pursuant to applicable provisions of the Illinois Insurance Code under which the entities are licensed. Makes changes in the provision excluding the specified division of fees from grounds for disciplinary action. HOUSE AMENDMENT NO. 2. Provides that a hospital may be the licensed health care facility dividing fees with one or more optometrists.
