House Sponsors: DART-GASH-ACEVEDO-CROTTY. Short description: VEH CD-FIELD SOBRIETY Synopsis of Bill as introduced: Amends the Illinois Vehicle Code. Provides that a person who drives or is in actual physical control of a motor vehicle upon the public highways of this State is deemed to have given consent to standardized field sobriety tests or a portable breathalyzer test, or both, if a law enforcement officer has reasonable suspicion of the driver's impairment. Provides that the results of the test may be used by the defendant as evidence in an administrative or court proceeding involving DUI or implied consent. Provides for suspension of a driver's license if a person refuses the field sobriety test or the portable breathalyzer test. Permits the Secretary of State to issue a restricted driving permit following the suspension of driving privileges after at least 30 days from the effective date of the suspension. Provides that following a second or subsequent suspension of driving privileges that is based upon the person having refused or failed to complete a test or tests to determine his or her alcohol concentration, the Secretary of State may issue a restricted driving permit after at least 6 months from the effective date of the suspension.
