Short description: 
MANAGED CARE CONFIRM DRUG BNFT                                             

Synopsis of Bill as introduced:
        Amends the Managed Care Reform and Patient Rights Act.   Provides      
   that  if a health care plan requires confirmation of benefits before a      
   prescription is filled, the plan must provide access 24 hours a day, 7      
   days a week to persons  authorized  to  confirm  benefits.   Effective      
   immediately.                                                                
        HOUSE AMENDMENT NO. 1.                                                 
        Provides that a  contract  between  a  health  care  plan  and  a      
   pharmaceutical  provider  shall  include  terms  that will ensure that      
   pharmacy  providers  have  continuous  access   to   confirmation   of      
   pharmaceutical benefits covered by the plan.  Effective immediately.        
          FISCAL NOTE, H-AM 1 (Dept. of Central Management Services)           
          As amended, the estimated fiscal impact remains $400,000.            
          That amount includes an estimated $350,000 for State Employees       
          Health Insurance Plan and the remainder for the Teachers'            
          Retirement Insurance Program, College Insurance Program, and         
          the Local Government Health Plan.                                    
          STATE MANDATES NOTE, H-AM 1                                          
          (Department of Commerce and Community Affairs)                       
          HB 3117 (H-am 1) creates a personnel mandate for which reim-         
          bursement of 100% of the increased cost to units of local            
          government is required. An estimate of the cost to units of          
          local government is not available at this time.                      
          HOME RULE NOTE, H-AM 1                                               
          (Department of Commerce and Community Affairs)                       
          This legislation would be subject to the home rule authority         
          pre-emption contained in the Managed Care Reform and Patient         
          Rights Act.                                                          
          FISCAL NOTE, H-AM 1 (Department of Insurance)                        
          This legislation will have no fiscal impact on the Department.
