Senate Sponsors: KLEMM-PETERSON Short description: TOLL HWY-REIMBURSE DOT-CONDEMN Synopsis of Bill as introduced: Amends the Illinois Highway Code by repealing the Section permitting the Department of Transportation to convey title to certain lands, rights, or properties to the Illinois State Toll Highway Authority without compensation. Amends the Toll Highway Act. Deletes the provision authorizing the Toll Highway Authority to accept the conveyance of land from the Department of Transportation. Requires the Illinois State Toll Highway Authority to reimburse the Department of Transportation or other agency or department of the State of Illinois for all costs and administrative overhead associated with the development, planning, promotion, construction, land acquisition, contracting, and other improvements incurred on behalf of the Authority. Requires the Authority to comply with the same eminent domain requirements as other State agencies. FISCAL NOTE, H-AM 1 (Department of Transportation) Cost is estimated at approximately $47.4 million. HOUSE AMENDMENT NO. 1. Amends the Illinois Highway Code. Provides that when the Department of Transportation conveys to the Illinois State Toll Highway Authority an interest in land, rights or other property acquired in connection with a federal-aid project that ceases to exist, the Department must receive compensation equal to the fair market value of the interest conveyed (instead of without compensation) to be deposited into the Road Fund. FISCAL NOTE, H-AM 1 (Illinois Toll Highway Authority) It is unclear as to the value of this property and therefore no dollar figure can be attributed to it, however, it is clear that the passage of this bill would result in an increased cost to the Tollway to construct any new roadway.
