Eliminates current law relating to admissibility of prior statements when a witness refuses to testify despite a court order to testify. Provides for the admissibility of certain hearsay statements when the declarant is unavailable as a witness. Includes former testimony, statements under belief of impending death, statements against interest, statements of personal or family history, and statements that have equivalent circumstantial guarantees of trustworthiness if the court determines that the statement is offered as evidence of a material fact, the statement is more probative on the point for which it is offered than any other evidence that the proponent can procure through reasonable effort, and the interests of justice will be served by the admission of the statement into evidence.
