Short description: 
ENDANGERED SPECIES PROTECT ACT                                             

Synopsis of Bill as introduced:
        Amends the Illinois Natural  Areas  Preservation  Act.   Provides      
   that  cemetery  land  dedicated  before  1990  as a nature preserve or      
   buffer area may be returned to use as a cemetery upon  the  demand  of      
   the cemetery authority.                                                     
        HOUSE AMENDMENT NO. 1.                                                 
        Provides that cemetery land dedicated before 1990  shall,  rather      
   than  may,  be  returned  to  use as a cemetery upon the demand of the      
   cemetery authority.                                                         
        SENATE AMENDMENT NO. 1.                                                
        Provides that a cemetery or a portion  of  a  cemetery  dedicated      
   during  1984,  rather  than before 1990, shall be returned to use as a      
   cemetery upon the demand of the cemetery authority.                         
        SENATE AMENDMENT NO. 2.                                                
          Deletes reference to:                                                
          525 ILCS 30/11                                                       
          Adds reference to:                                                   
          520 ILCS 10/5.5 new                                                  
          520 ILCS 10/11                                                       
        Deletes  everything.   Amends  the  Illinois  Endangered  Species      
   Protection Act.  Provides that under prescribed terms and  conditions,      
   the  Department  of Natural Resources may authorize a taking otherwise      
   prohibited by the Act  if  the  taking  of  the  protected  animal  is      
   incidental  to  and  not  the purpose of an otherwise lawful activity.      
   Provides that if the Department authorizes an incidental taking  of  a      
   protected  species,  the  Department  must  file  a  written  decision      
   explaining  its  conclusion  that  the  taking  should  be authorized.      
   Provides  that  in  order  to  authorize  an  incidental  taking,  the      
   Department must determine that, based on the best available scientific      
   data, the taking will not reduce the likelihood of the survival of the      
   endangered or protected species.  Provides that  the  public  must  be      
   given notice of, and an opportunity to comment on, the application for      
   an incidental taking before the taking may be authorized.
