Contains provisions concerning privatization requirements, when privatization is permissible, contractor eligiblity, performance reports, procedures, worker protection, and other matters. Effective immediately. CORRECTIONAL NOTE (Department of Corrections) Corrections population impact=none; fiscal impact=$334,300 to $1,769,300 annually. FISCAL NOTE (Department of Corrections) No change from DOC fiscal note. STATE MANDATES NOTE (Dept. of Commerce and Community Affairs) Does not create a State mandate. HOUSE AMENDMENT NO. 1. Changes the definition of "cost-effectiveness study". Deletes certain conditions that must be met to permit privatization and changes some of the remaining conditions. Deletes provision requiring a contractor to submit an eligibility report to the Office of the Comptroller. Provides that the eligibility report shall be available for public inspection upon request. Changes the information that must be included on an eligibility report. Deletes the provision requiring a contractor awarded procurement to submit annual performance reports to the Office of the Comptroller. Provides that annual performance reports shall be available for public inspection upon request. Makes other changes. SENATE AMENDMENT NO. 1. Deletes the substance of the bill. Provides that contracts that include the privatization of nursing care services at correctional facilities shall contain a requirement that the vendor may not pay wages and benefits at a rate lower than that provided to entry level State nurses. Applies only to contracts entered into on or after the effective date of the Act.
