Senate Sponsors: BOWLES-MUNOZ Short description: CANNABIS & CONT SUBS-PRECURSOR Synopsis of Bill as introduced: Amends the Cannabis Control Act. Creates the offense of use of a dangerous place for the commission of a cannabis offense. Penalty is a Class X felony. Amends the Illinois Controlled Substances Act. Prohibits the possession of an immediate precursor of a controlled or counterfeit substance or controlled substance analog with intent to illegally manufacture a controlled or counterfeit substance or controlled substance analog. Prohibits the possession of an immediate chemical intermediary with the intent to manufacture a controlled or counterfeit substance or controlled substance analog. Creates the offense of use of a dangerous place for the commission of a controlled substance offense. Penalty is a Class X felony. CORRECTIONAL NOTE (Department of Corrections) Corrections population impact would be 24 inmates; fiscal impact would be $4,444,800. SENATE AMENDMENT NO. 2. Deletes reference to: 720 ILCS 550/9.1 new 720 ILCS 570/406.2 new Deletes the title and everything after the enacting clause. Deletes amendatory changes to the Cannabis Control Act. Amends the Illinois Controlled Substances Act. Provides that the new penalties apply to possession of a methamphetamine manufacturing chemical with intent to manufacture a substance containing methamphetamine. Deletes provision creating the offense of use of a dangerous place for the commission of a controlled substance offense. CONFERENCE COMMITTEE REPORT NO. 1. Recommends that the House concur in S-am 2. Recommends that the bill be further amended as follows: Deletes the definition of "drug manufacturing equipment". Deletes phenylacetic acid, 1-phenyl-1, 2-propanedione, phenylpropanol, and propiophenone from the definition of "methamphetamine manufacturing chemical". Eliminates the inference that a person who possessed any methamphetamine manufacturing chemical intended to use the entire amount of such substance to manufacture methamphetamine or salt of an optical isomer of methamphetamine if such substance was found in close proximity to a drug manufacturing facilitator or equipment suitable for assisting in the manufacture of methamphetamine or salt of an optical isomer of methamphetamine.
