Senate Sponsors: CRONIN Short description: CRIM CD-CIV PRO-DISCOVERY DEPO Synopsis of Bill as introduced: Amends the Code of Criminal Procedure of 1963 and the Code of Civil Procedure. Permits discovery depositions to be admitted into evidence if the witness is unable to be present or to testify at the trial because of death, physical or mental illness, or infirmity or if the party offering the deposition into evidence is unable to procure the witness' attendance by process. HOUSE AMENDMENT NO. 1. Deletes reference to: 725 ILCS 5/115-5.2 new Deletes the amendatory changes to the Code of Criminal Procedure of 1963. Provides that these provisions do not affect the utilization of evidence depositions under Supreme Court Rule.
