Senate Sponsors: PHILIP Short description: CRIM CD-DISCHARGE FIREARM-TECH Synopsis of Bill as introduced: Amends the Criminal Code of 1961 to make a technical change to the Section concerned with the reckless discharge of a firearm. SENATE AMENDMENT NO. 2. Deletes reference to: 720 ILCS 5/24-1.5 Adds reference to: 430 ILCS 65/13.2 from Ch. 38, par. 83-13.2 720 ILCS 5/24-1 from Ch. 38, par. 24-1 720 ILCS 5/24-1.6 new 720 ILCS 5/24-2 from Ch. 38, par. 24-2 Deletes everything. Amends the Criminal Code of 1961 to re-enact the unlawful use of weapons provisions of Public Act 88-680 that were declared unconstitutional by the Illinois Supreme Court in People v. Cervantes, Docket No. 87229, as violating the single subject provisions of the Illinois Constitution. Amends the Criminal Code of 1961 relating to unlawful use of weapons. Provides that a first offense for carrying or possessing a firearm in a vehicle or concealed upon one's person, or upon a public street or public lands within a municipality is a Class A misdemeanor. Provides that the carrying or possessing of a firearm in a place that is licensed to sell intoxicating beverages is a Class 4 felony (rather than a Class A misdemeanor) for a first offense and a Class 3 felony for a second or subsequent offense. Creates the offense of aggravated unlawful use of a weapon. Provides that the carrying or possessing of a firearm in a vehicle, concealed upon one's person, or upon a public street or public lands within a municipality is a Class 4 felony for a first offense and a Class 2 felony for a second or subsequent offense if certain aggravating factors are present. Establishes exemptions. Amends the Firearm Owners Identification Card Act. Provides that the Department of State Police must send notice of expiration to a card holder of a Firearm Owner's Identification Card by first class mail at least 60 days (rather than 30 days) before the expiration. Effective immediately. SENATE AMENDMENT NO. 3. Changes one of a series of alternative factors constituting an element of the offense of aggravated unlawful use of a weapon. Provides that the factor is that the person possessing the weapon is "a member of" (rather than "a member of or affiliated with") a street gang or is engaged in street gang related activity.
