Senate Sponsors: PETERSON Short description: ATTORNEYS-REPRESENT CHILD Synopsis of Bill as introduced: Amends the Illinois Marriage and Dissolution of Marriage Act and the Illinois Parentage Act of 1984. Replaces existing provisions regarding the appointment of an attorney to represent a child with a provision authorizing the court to appoint, in a case involving support, custody, visitation, education, parentage, property interest, or general welfare of a child, either (i) an attorney to represent the child, (ii) a guardian ad litem for the child, or (iii) a child's representative who will have the same power and authority to take part in the conduct of the litigation as does an attorney for a party and who will possess all the powers of investigation and recommendation as does a guardian ad litem. Provides for the appointment of more than one attorney for a child and for the payment of fees and costs for the appointed person. FISCAL NOTE (Dept. of Children and Family Services) There is no measurable fiscal impact. SENATE AMENDMENT NO. 1. Provides that the court may not order payment of attorney costs and fees by the Illinois Department of Public Aid in cases in which the Department is providing child and spouse support services under Article X of the Illinois Public Aid Code.
