Provides that the unlawful use or possession of weapons by felons is a Class 2 felony if the weapon possessed is a firearm. Provides that the offense is a Class 3 felony if the weapon possessed is not a firearm. (Now the offense is a Class 3 felony if the offender is not confined in a penal institution). Amends the Unified Code of Corrections. Provides that a person convicted of unlawful use or possession of weapons by felons or persons in the custody of the Department of Corrections is not eligible for probation, periodic imprisonment, or conditional discharge. CORRECTIONAL NOTE (Dept. of Corrections) The corrections population impact is 3,419 inmates and the fis- cal impact is $695,059,200.
