Senate Sponsors: HAWKINSON-NOLAND-SHADID Short description: CRIM PRO-HEARSAY-DECEASED Synopsis of Bill as introduced: Amends the Code of Criminal Procedure of 1963. Permits hearsay statements of deceased persons to be admitted into evidence if the statements are not covered by other hearsay exceptions but have equivalent circumstantial guarantees of trustworthiness and certain other conditions are met. Effective immediately. HOUSE AMENDMENT NO. 1. Provides that unavailability as a witness is limited to the situation in which the declarant is deceased. Provides that a prior statement sought to be admitted must have been made by the declarant under oath at a trial, hearing, or other proceeding.
