HALVORSON-WALSH,L-MUNOZ-MOLARO-RADOGNO AND DELEO. (NOVAK-JOHNSON,TOM-MCGUIRE-GASH-GRANBERG) 720 ILCS 135/1 from Ch. 134, par. 16.4 Amends the Harassing and Obscene Communications Act. Provides that it is a Class 4 felony to send any communications or messages or to use language or terms that purport to solicit a sexual act with a person, knowing the person to be under 18 years of age, by means of or while using a telephone or telegraph facilities, equipment, or wires or by means of an electronic communication of any person, firm, or corporation engaged in the transmission of news or messages between states or within this State. SENATE AMENDMENT NO. 2. Adds reference to: 720 ILCS 135/0.02 new Deletes provisions of the bill relating to soliciting a sexual act with a person under 18 years of age. Instead provides that a person at least 17 years of age who with the intent to offend, sends a communication or message or term that purports to solicit a sexual act with a person under 13 years of age by means of or while using an electronic communication, a telephone or equipment, or wires or by means of an electronic communication of a person, firm, or corporation engaged in the transmission of news or messages between states or within this State is guilty of a Class 4 felony. Excludes telecommunications carriers and Internet providers from the definition of person under the Act. FISCAL NOTE (Dept. of Corrections) The fiscal and corrections impact is minimal.
