HASSERT AND LOPEZ. (CRONIN-HALVORSON) 105 ILCS 5/7-2b from Ch. 122, par. 7-2b 105 ILCS 5/2-3.105a rep. Amends the School Code. In provisions concerning the annexation of non-coterminous territory from an elementary or high school district, replaces references to the State Board of Education with references to the regional board of school trustees. Also provides that any contiguous portion of the district that constitutes 5% (instead of 10%) or less of the equalized assessed value of the district may be detached and annexed, and prohibits a district from losing more than 5% of its equalized assessed value through petitions filed under these provisions. Repeals a provision requiring the State Board of Education to exercise certain rights, powers, duties, and responsibilities under the provisions concerning the annexation of non-coterminous territory from an elementary or high school district. Makes other related changes. SENATE AMENDMENT NO. 1. Provides that the contiguous portion of the district must also constitute 5% or less of the territory of the district in order to be detached and annexed. Provides that no district may lose more than 5% of its territory through petitions filed under the provisions concerning the annexation of non-coterminous territory from an elementary or high school district, and provides that if a petition seeks to detach territory that would result in a cumulative total of more than 5% of a district's territory being detached under these provisions, the petition be shall denied. Makes other changes.
