Amends the Criminal Code of 1961. Provides that certain offenses of domestic violence committed in the presence of a minor will be subject to a minimum sentence of imprisonment for 10 days or 300 hours community service, or both. Includes various offenses of criminal sexual assault as a basis for charging a now lesser-included felony offense of home invasion. Broadens the definition of the felony offense of residential burglary to include situations where the offender entered with authority but then unlawfully remained in order to commit a felony or theft, and to include situations where the offender entered not only a dwelling, but also "any part thereof". Revises the law so that burglary and residential burglary are no longer mutually exclusive, making burglary a lesser-included offense of residential burglary. GOVERNOR'S AMENDATORY VETO MESSAGE Recommends making home invasion a Class X felony if criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, or aggravated crim- inal sexual abuse is committed against a person within the dwelling place. 99-02-10 H FIRST READING 99-02-10 H REFERRED TO HOUSE RULES COMMITTEE RULES 99-02-17 H ASSIGNED TO COMMITTEE EXECUTIVE 99-02-25 H DO PASS/STANDARD DEBATE 008-007-000 HEXC 99-02-25 H PLACED CAL 2ND READING-STANDARD DEBATE 99-02-26 H RE-COMMITTED TO COMMITTEE EXECUTIVE 99-03-05 H DO PASS/SHORT DEBATE 015-000-000 HEXC 99-03-05 H PLACED CALENDAR 2ND READING-SHORT DEBATE 99-03-16 H SECOND READING-SHORT DEBATE 99-03-16 H HELD ON CAL ORDER 2ND RDG - SHORT DEBATE 99-03-26 H PLCD CAL ORDER 3RD READING-SHORT DEBATE 99-03-26 H THIRD READING/SHORT DEBATE/PASSED 104-009-001 99-04-14 S ARRIVE IN SENATE 99-04-14 S PLACED CALENDAR ORDER OF FIRST READING 99-04-15 00-01-12 S CHIEF SPONSOR PHILIP 00-01-12 S FIRST READING 00-01-12 S REFERRED TO SENATE RULES COMMITTEE RULES 00-01-12 S ASSIGNED TO COMMITTEE EXECUTIVE 00-01-27 S POSTPONED 00-02-10 S POSTPONED 00-02-17 S POSTPONED 00-03-09 S DO PASS 013-000-000 SEXC 00-03-09 S PLACED ON CALENDAR ORDER OF 2ND READING 00-03-22 00-03-28 S SECOND READING 00-03-28 S PLACED ON CALENDAR ORDER OF 3RD READING 00-03-29 00-04-07 S FILED WITH SECRETARY 00-04-07 S AMENDMENT NO. 01-PHILIP 00-04-07 S AMENDMENT REFERRED TO SRUL 00-04-07 S AMENDMENT NO. 01-PHILIP 00-04-07 S RULES REFERS TO SEXC 00-04-07 S AMENDMENT NO. 01-PHILIP 00-04-07 S BE ADOPTED SEXC/012-000-000 00-04-07 S RECALLED TO SECOND READING 00-04-07 S AMENDMENT NO. 01-PHILIP 00-04-07 S ADOPTED 00-04-07 S PLACED ON CALENDAR ORDER OF 3RD READING 00-04-07 S THIRD READING - PASSED 058-000-000 00-04-07 H ARRIVE IN HOUSE 00-04-07 H PLACED ON CALENDAR ORDER OF CONCURRENCE 01 00-04-10 H MOTION FILED CONCUR 01/WINKEL 00-04-10 H MOTION REFERRED TO HRUL 00-04-10 H CALENDAR ORDER OF CONCURRENCE 01 00-04-11 H MOTION FILED CONCUR 01/WINKEL 00-04-11 H RULES REFERS TO HJUB 00-04-11 H CALENDAR ORDER OF CONCURRENCE 01 00-04-11 H ADDED AS A JOINT SPONSOR POE 00-04-11 H ADDED AS A JOINT SPONSOR O'CONNOR 00-04-12 H MOTION FILED CONCUR 01/WINKEL 00-04-12 H APPROVED FOR CONSIDERATION HJUB/007-004-000 00-04-12 H CALENDAR ORDER OF CONCURRENCE 01 00-04-12 H ADDED AS A JOINT SPONSOR MATHIAS 00-04-13 H HSE CONCURS IN SEN AMENDMENTS (NO.) 01/090-015-011 00-04-13 H PASSED BOTH HOUSES 00-05-12 H SENT TO THE GOVERNOR 00-07-06 H GOVERNOR AMENDATORY VETO 00-07-06 H PLACED CALENDAR AMENDATORY VETO NOVEMBER 14, 2000 00-11-13 H MOTION FILED ACCEPT AMENDATORY VETO WINKEL 00-11-13 H MOTION REFERRED TO HRUL 00-11-13 H PLACED CALENDAR AMENDATORY VETO 00-11-15 H APPROVED FOR CONSIDERATION - COMPLIANCE HRUL/004-000-000 00-11-15 H ACCEPT AMENDATORY VETO - HOUSE PASSED 115-000-000 00-11-28 S PLACED CALENDAR AMENDATORY VETO NOVEMBER 29, 2000 00-11-29 S MOTION FILED ACCEPT AMENDATORY VETO PHILIP 00-11-29 S ACCEPT AMENDATORY VETO - SENATE PASSED 058-000-000 00-11-29 H BOTH HOUSES ACCEPT AMENDATORY VETO 00-12-11 H RETURNED TO GOVERNOR FOR CERTIFICATION 00-12-15 H GOVERNOR CERTIFIES CHANGES 00-12-15 H EFFECTIVE DATE 01-06-01 00-12-15 H PUBLIC ACT.............................. 91-0928 END OF INQUIRY Full Text Bill Summary
