O'BRIEN-MCGUIRE-FEIGENHOLTZ-FRITCHEY-GASH, 
   LANG AND ZICKUS.

(WALSH,L-CULLERTON)

   510 ILCS 70/3.03 new                                                        
   510 ILCS 70/16            from Ch. 8, par. 716                              

        Amends the Humane Care for Animals Act.  Creates the  offense  of      
   animal  torture  as a Class 4 felony, committed when a person inflicts      
   extreme physical pain on an animal with  the  intent  to  increase  or      
   prolong  the  animal's  pain,  suffering,  or  agony.  Provides that a      
   second or subsequent offense is a Class 3 felony.    Provides  that  a      
   person   convicted  of  the  offense  shall  be  required  to  undergo      
   psychological or  psychiatric  evaluation  and  treatment.   Effective      
   immediately.

        HOUSE AMENDMENT NO. 1.                                                 
        Provides that acts by persons engaged in lawful fishing, hunting,      
   or trapping  under the Wildlife Code or the Fish and Aquatic Life Code      
   and acts that are customary practices by persons engaged in scientific      
   or medical experiments  or  persons  engaged  in  meat  packing,  meat      
   processing,   or the  slaughtering of animals or  transporting animals      
   for slaughter  are exempt  from the new Section  regarding the offense      
   of animal torture.
