Provides that new vehicle dealers and used vehicle dealers must provide automobile liability for the amount of $20,000 for bodily injury to, or death of, any person, $40,000 for bodily injury to, or death of, 2 or more persons in any one accident, and $15,000 for damage to property for any permitted user of the new vehicle dealer's vehicle or used vehicle dealer's vehicle if the permitted user has no automobile liability insurance of his or her own or has automobile insurance coverage of less than the minimum limits provided. FISCAL NOTE (Dept. of Insurance) HB604 will have no fiscal impact on the Department. HOUSE AMENDMENT NO. 1. Deletes everything. Reinserts the bill as introduced with certain exceptions. Provides that the required liability insurance policy of new and used vehicle dealers shall have minimum coverage of $100,000 for bodily injury to, or death of, any person, $300,000 for bodily injury to, or death of, two or more persons in any one accident, and $50,000 for damage to property for any permitted user of the new vehicle dealer's auto if the permitted user has no automobile liability insurance of his or her own or has insurance below specified levels of coverage (instead of limits of $20,000, $40,000, or $15,000, respectively). Applies only to actions commenced or pending on or after the effective date of this amendatory Act. SENATE AMENDMENT NO. 1. Further amends the Illinois Vehicle Code to provide that the automobile liability coverage that new and used automobile dealers are required to provide applies only to permitted users. Provides that a permitted user's insurance is the primary insurance. Defines "permitted user" to exclude certain officers, directors, and employees of new and used vehicle dealers, as well as their spouses. GOVERNOR'S AMENDATORY VETO MESSAGE Recommends that the bill be amended to delete language providing that the dealer's insurance would apply only as excess over any avail- able underinsured motorists' coverage.
