91_SR0202 SRS91SR0027DLsa 1 SENATE RESOLUTION 2 WHEREAS, the federal Personal Responsibility and Work 3 Opportunity Reconciliation Act of 1996 (P.L. 104-193) 4 required all states to create a centralized state 5 disbursement unit for the collection and disbursement of 6 certain child support checks; and 7 WHEREAS, Illinois' state disbursement unit began 8 operating on October 1, 1999; and 9 WHEREAS, Unforeseen delays have occurred in processing 10 and distributing child support checks to custodial parents 11 throughout the state; and 12 WHEREAS, Many custodial parents are facing extreme 13 financial hardship as a result of this unfortunate delay in 14 processing of child support checks; and 15 WHEREAS, This delay has left many parents unable to pay 16 necessary expenses such as rent or mortgage payments, utility 17 payments, day care bills, and food expenses; and 18 WHEREAS, Custodial parents throughout the state, waiting 19 for their child support payments, are incurring or at risk of 20 incurring late fees, financial penalties, or loss of crucial 21 services such as housing, utilities, and day care services; 22 and 23 WHEREAS, Custodial parents should not be financially or 24 otherwise penalized for the delay in processing of child 25 support checks; and 26 WHEREAS, The Department of Public Aid and the state 27 disbursement unit are working together to expeditiously 28 resolve the backlog in child support payments; and 29 WHEREAS, This unfortunate situation offers an 30 unprecedented opportunity for businesses and creditors to be -2- SRS91SR0027DLsa 1 compassionate and lend a helping hand to those in need; 2 therefore be it 3 RESOLVED, BY THE SENATE OF THE NINETY-FIRST GENERAL 4 ASSEMBLY OF THE STATE OF ILLINOIS, That the members of the 5 Illinois State Senate respectfully urge all utility 6 companies, day care centers, land-lords, mortgage companies 7 and other creditors to recognize the hardships custodial 8 parents are facing due to the delays in receiving child 9 support payments; and be it further 10 RESOLVED, That the members of the Illinois State Senate 11 respectfully ask all creditors to exercise restraint by not 12 terminating services or otherwise imposing financial 13 penalties on custodial parents experiencing delays in 14 receiving child support payments.
