 1                       SENATE JOINT RESOLUTION

 2        WHEREAS, Individuals, over the age of 17,  with  Acquired
 3    Brain  Injuries  may  require  supervision and care following
 4    medical rehabilitation which can only be  provided  within  a
 5    structured residential setting; and

 6        WHEREAS,  over  5,500  head injuries were reported to the
 7    Department of Public Health Trauma Register for each  of  the
 8    calendar years of 1996 and 1997; and

 9        WHEREAS,  the Department of Public Health Trauma Register
10    reports that following emergency treatment that three out  of
11    every  four  head  injury  patients  were discharged to their
12    homes and communities without medical follow-up.

13        WHEREAS, Individuals with Acquired Brain Injuries needing
14    this type of long term care  have  no  consistent  access  to
15    residential  services  and are typically found ineligible for
16    any existing residential option; and

17        WHEREAS, Without appropriate supervision in a  structured
18    residential  setting individuals with Acquired Brain Injuries
19    can become a severe burden upon family and communities; and

20        WHEREAS, Individuals with Acquired Brain Injuries deserve
21    an  array  of   treatment   options   including   appropriate
22    residential   care   which   provides   needed   supervision,
23    treatment, and stimulation; and

24        WHEREAS,  Individuals  with  Acquired Brain Injuries have
25    recently acquired access to community based services  through
26    the  Department  of Human Services which does not provide for
27    appropriate residential services through the Medicaid  Waiver
28    program; and

29        WHEREAS,  The Department of Human Services has issued the
30    Final Report of the Illinois Traumatic Brain Injury  Planning

 1    Project in January 1998; and

 2        WHEREAS, This report identifies that existing residential
 3    options  provide  inappropriate  care,  and  when appropriate
 4    residential services are available they are in short  supply;
 5    therefore, be it

 6        RESOLVED,  BY  THE  SENATE  OF  THE  NINETY-FIRST GENERAL
 7    ASSEMBLY  OF  THE   STATE   OF   ILLINOIS,   THE   HOUSE   OF
 8    REPRESENTATIVES  CONCURRING  HEREIN,  that  the Community and
 9    Residential Services Authority shall convene a Task Force  to
10    investigate  the extent to which appropriate residential care
11    facilities for Individuals with Acquired Brain Injuries exist
12    and explore options  for  providing  appropriate  residential
13    facilities; and be it further

14        RESOLVED,  That  in  addition  to a representative of the
15    Community and Residential Services  Authority  who  shall  be
16    Chairperson, the membership of the Task Force shall include a
17    representative   of  the  Department  of  Human  Services,  a
18    representative  of  the   State   Board   of   Education,   a
19    representative of the Brain Injury Association, one member of
20    the  Senate  and one public member appointed by the President
21    of the Senate, one member of the Senate and one public member
22    appointed by the  Minority Leader of the Senate,  one  member
23    of  the  House and one public member appointed by the Speaker
24    of the House of Representatives, and one member of the  House
25    and one public member appointed by the Minority Leader of the
26    House  of  Representatives.   All  of who shall serve without
27    compensation but shall be reimbursed for their reasonable and
28    necessary expenses.  Public members shall be  experienced  or
29    knowledgeable   relative   to   provision   of  services  for
30    individuals with Acquired Brain Injuries.   Staff  assistance
31    for  the  Task  Force  will  be provided by the Community and
32    Residential Services Authority and the  Task  Force  expenses
33    shall  be  paid  from  the  appropriation  for  ordinary  and

 1    contingent expenses of the Authority; and be it further

 2        RESOLVED,  That  the  findings and recommendations of the
 3    Task Force be delivered to the House  and  Senate  by  filing
 4    copies  of  its  report  with  the Clerk of the House and the
 5    Secretary of the Senate on or before December 31,  2001;  and
 6    that upon filing its report, the Task Force is dissolved.
