91_SB1959 LRB9113813DHmb 1 AN ACT to amend the Kaskaskia River Watershed and Basin 2 Act by changing Section 1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Kaskaskia River Watershed and Basin Act 6 is amended by changing Section 1 as follows: 7 (615 ILCS 75/1) (from Ch. 19, par. 41.1) 8 Sec. 1. The Department of Natural Resources may 9 independently engage in, or may make agreements with any 10 agency of the United States, any municipality or political 11 subdivision of this State or any public or private 12 corporation, person or association for, the formulation of 13 plans, acquisition of rights of way, and the construction, 14 operation and maintenance of any navigation, flood control, 15 drainage, levee, water supply and water storage, including 16 regulation, distribution and use, and other water resource 17 improvements and facilities in connection with the 18 development of the Kaskaskia River watershed, including 19 restriction of use or withdrawal of water from the Kaskaskia 20 River below Carlyle Dam or providing for replenishment of 21 withdrawn water, provided however, the Department shall not 22 charge for the use or withdrawal of water from the Kaskaskia 23 River, except that the Department may recoup from water users 24 an amount required to pay federal operation and maintenance 25 charges incurred as a result of water withdrawal from Lake 26 Shelbyville and Carlyle Lake. 27 The Department, on behalf of the State of Illinois as 28 local sponsor for federally authorized and developed 29 Kaskaskia River basin projects, shall have jurisdiction and 30 supervision over any and all phases of developments and 31 improvements in such basin, including, but not limited to -2- LRB9113813DHmb 1 nonfederal participation requirements in connection 2 therewith, and full authority and control over any and all 3 lands acquired in connection with the development of the 4 Kaskaskia River watershed and may, in the discretion of the 5 Department, grant easements, lease for a period not to exceed 6 50 years, sell, transfer or convey, exchange, develop, or 7 otherwise utilize such lands in the interest of the State of 8 Illinois insofar as the same is not inconsistent or in 9 conflict with the purpose for which acquired by the 10 Department. 11 (Source: P.A. 88-565, eff. 8-5-94; 89-445, eff. 2-7-96.) 12 Section 99.
