91_SB1917 SRS91S0083GHbm 1 AN ACT in relation to gambling, amending certain named 2 Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Horse Racing Act of 1975 is 6 amended by adding Section 34.2 as follows: 7 (230 ILCS 5/34.2 new) 8 Sec. 34.2. Prohibition against automated teller machines 9 and post-dated checks. 10 (a) An organization licensee may not conduct or 11 authorize any of the following at its race track or at any of 12 its inter-track locations or inter-track wagering locations 13 nor may any other person conduct any of the following at a 14 race track, inter-track location, or inter-track wagering 15 location: 16 (1) the installation or operation of an automated 17 teller machine; 18 (2) the cashing of any post-dated check; or 19 (3) the cashing of any welfare check. 20 (b) An organization licensee or a bank or a 21 representative of an organization licensee or bank may not 22 loan money to any person at a race track, inter-track 23 location, or inter-track wagering location. 24 (c) For the purpose of this Section, the term "automated 25 teller machine" has the same meaning as in the Automated 26 Teller Machine Security Act. For the purpose of this Act, the 27 term "bank" has the same meaning as in the Illinois Banking 28 Act. 29 (d) A person who violates this Section commits a Class B 30 misdemeanor. -2- SRS91S0083GHbm 1 Section 10. The Riverboat Gambling Act is amended by 2 adding Section 13.2 and changing Section 18 as follows: 3 (230 ILCS 10/13.2 new) 4 Sec. 13.2. Prohibition against automated teller machines 5 and post-dated checks. 6 (a) An owners licensee or any other person may not: 7 (1) install or permit the installation or operation 8 of any automated teller machines on a riverboat or on its 9 dock; 10 (2) authorize the cashing of any post-dated check 11 on a riverboat or on its dock; or 12 (3) authorize the cashing of any welfare check on a 13 riverboat or on its dock. 14 (b) An owners licensee or a bank or a representative of 15 an owners licensee or a bank may not loan money to any person 16 on a riverboat or on its dock. 17 (c) For the purpose of this Section, the term "automated 18 teller machine" has the same meaning as in the Automated 19 Teller Machine Security Act. For the purpose of this Section, 20 the term "bank" has the same meaning as in the Illinois 21 Banking Act. 22 (230 ILCS 10/18) (from Ch. 120, par. 2418) 23 Sec. 18. Prohibited Activities - Penalty. 24 (a) A person is guilty of a Class A misdemeanor for 25 doing any of the following: 26 (1) Conducting gambling where wagering is used or 27 to be used without a license issued by the Board. 28 (2) Conducting gambling where wagering is permitted 29 other than in the manner specified by Section 11. 30 (b) A person is guilty of a Class B misdemeanor for 31 doing any of the following: 32 (1) permitting a person under 21 years to make a -3- SRS91S0083GHbm 1 wager;or2 (2) violating paragraph (12) of subsection (a) of 3 Section 11 of this Act; or.4 (3) violating Section 13.2 of this Act. 5 (c) A person wagering or accepting a wager at any 6 location outside the riverboat is subject to the penalties in 7 paragraphs (1) or (2) of subsection (a) of Section 28-1 of 8 the Criminal Code of 1961. 9 (d) A person commits a Class 4 felony and, in addition, 10 shall be barred for life from riverboats under the 11 jurisdiction of the Board, if the person does any of the 12 following: 13 (1) Offers, promises, or gives anything of value or 14 benefit to a person who is connected with a riverboat 15 owner including, but not limited to, an officer or 16 employee of a licensed owner or holder of an occupational 17 license pursuant to an agreement or arrangement or with 18 the intent that the promise or thing of value or benefit 19 will influence the actions of the person to whom the 20 offer, promise, or gift was made in order to affect or 21 attempt to affect the outcome of a gambling game, or to 22 influence official action of a member of the Board. 23 (2) Solicits or knowingly accepts or receives a 24 promise of anything of value or benefit while the person 25 is connected with a riverboat including, but not limited 26 to, an officer or employee of a licensed owner, or holder 27 of an occupational license, pursuant to an understanding 28 or arrangement or with the intent that the promise or 29 thing of value or benefit will influence the actions of 30 the person to affect or attempt to affect the outcome of 31 a gambling game, or to influence official action of a 32 member of the Board. 33 (3) Uses or possesses with the intent to use a 34 device to assist: -4- SRS91S0083GHbm 1 (i) In projecting the outcome of the game. 2 (ii) In keeping track of the cards played. 3 (iii) In analyzing the probability of the 4 occurrence of an event relating to the gambling 5 game. 6 (iv) In analyzing the strategy for playing or 7 betting to be used in the game except as permitted 8 by the Board. 9 (4) Cheats at a gambling game. 10 (5) Manufactures, sells, or distributes any cards, 11 chips, dice, game or device which is intended to be used 12 to violate any provision of this Act. 13 (6) Alters or misrepresents the outcome of a 14 gambling game on which wagers have been made after the 15 outcome is made sure but before it is revealed to the 16 players. 17 (7) Places a bet after acquiring knowledge, not 18 available to all players, of the outcome of the gambling 19 game which is subject of the bet or to aid a person in 20 acquiring the knowledge for the purpose of placing a bet 21 contingent on that outcome. 22 (8) Claims, collects, or takes, or attempts to 23 claim, collect, or take, money or anything of value in or 24 from the gambling games, with intent to defraud, without 25 having made a wager contingent on winning a gambling 26 game, or claims, collects, or takes an amount of money or 27 thing of value of greater value than the amount won. 28 (9) Uses counterfeit chips or tokens in a gambling 29 game. 30 (10) Possesses any key or device designed for the 31 purpose of opening, entering, or affecting the operation 32 of a gambling game, drop box, or an electronic or 33 mechanical device connected with the gambling game or for 34 removing coins, tokens, chips or other contents of a -5- SRS91S0083GHbm 1 gambling game. This paragraph (10) does not apply to a 2 gambling licensee or employee of a gambling licensee 3 acting in furtherance of the employee's employment. 4 (e) The possession of more than one of the devices 5 described in subsection (d), paragraphs (3), (5) or (10) 6 permits a rebuttable presumption that the possessor intended 7 to use the devices for cheating. 8 An action to prosecute any crime occurring on a riverboat 9 shall be tried in the county of the dock at which the 10 riverboat is based. 11 (Source: P.A. 91-40, eff. 6-25-99.) 12 Section 99.
