91_SB1845 LRB9113039WHcsA 1 AN ACT to amend the Unemployment Insurance Act by adding 2 Section 500.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unemployment Insurance Act is amended by 6 adding Section 500.1 as follows: 7 (820 ILCS 405/500.1 new) 8 Sec. 500.1. Birth and adoption unemployment benefits. 9 (a) An individual who is on a leave of absence from his 10 or her employer or who left employment to be with the 11 individual's child during the first year of life, or during 12 the first year following placement with the individual for 13 adoption, shall not be denied benefits on the basis of any of 14 the grounds set forth in Section 601, 603, or 604. For 15 purposes of this Section, placement for adoption occurs at 16 the time a parent becomes legally responsible for a child 17 pending adoption. 18 (b) Sections 610 and 611 shall apply to benefits under 19 this Section. In addition, the following payments shall cause 20 a reduction in the benefit amount: 21 (1) any payment from the employer resulting from a 22 birth or adoption described in subsection (a); and 23 (2) any payment resulting from a birth or adoption 24 described in subsection (a) from a disability insurance 25 plan contributed to by an employer, in proportion to the 26 employer's contribution to such plan. 27 (c) Benefits are payable to an individual under this 28 Section for a maximum of 12 weeks with respect to any birth 29 or placement for adoption. 30 (d) Each employer shall post at each site operated by 31 the employer, in a conspicuous place, accessible to all -2- LRB9113039WHcsA 1 employees, information relating to the availability of birth 2 and adoption unemployment benefits. 3 (e) Any benefits paid under this Section shall not be 4 charged to the account of the individual employer. 5 (f) Not later than 2 years following the effective date 6 of this amendatory Act of the 91st General Assembly, the 7 Director shall issue a report to the Governor and the General 8 Assembly evaluating the effectiveness of the birth and 9 adoption unemployment benefit program. 10 (g) This Section shall be applied consistent with 11 regulations issued by the U.S. Department of Labor. The 12 Director may adopt rules making changes concerning the 13 operation of this Section that are necessary to comply with 14 final regulations issued by the U.S. Department of Labor. 15 Section 99. This Act takes effect upon becoming law or 16 on the effective date of regulations adopted by the U.S. 17 Department of Labor implementing a birth and adoption 18 unemployment compensation program, whichever is later.
