91_SB1624 LRB9112675DJcd 1 AN ACT to amend the Illinois Public Aid Code by adding 2 Section 5-2.05. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Public Aid Code is amended by 6 adding Section 5-2.05 as follows: 7 (305 ILCS 5/5-2.05 new) 8 Sec. 5-2.05. Medical assistance for child care providers. 9 (a) The Illinois Department shall provide medical 10 assistance under this Article to providers of child care 11 services paid for by the Illinois Department under Article 12 IXA who meet the eligibility requirements of this subsection. 13 A provider of child care services in a facility licensed 14 as a day care home or group day care home under the Child 15 Care Act of 1969 is eligible for medical assistance under 16 this subsection if the provider rendered at least $1,800 in 17 child care services paid for by the Illinois Department under 18 Article IXA during a period of 6 consecutive months before 19 applying for medical assistance under this subsection. 20 If the Illinois Department determines that a provider is 21 eligible for medical assistance under this subsection, the 22 Illinois Department shall enroll the provider and the 23 provider's minor children who are living with provider's 24 household in the medical assistance program for the following 25 6 months. The enrolled provider and qualifying children are 26 subject to the terms, conditions, limitations, and 27 restrictions of the medical assistance program. 28 (b) The Illinois Department shall establish a health care 29 premium cost-sharing option under the medical assistance 30 program for providers of child care in facilities licensed as 31 a day care center or group home under the Child Care Act of -2- LRB9112675DJcd 1 1969 who provide child care services paid for in whole or in 2 part by the Illinois Department or the Department of Children 3 and Family Services and who meet the eligibility requirements 4 of this subsection. 5 A provider is eligible to participate in the option under 6 this subsection if: 7 (1) the provider demonstrates that it meets the 8 minimum subsidized child care participation rates 9 specified in this subsection for the applicable period; 10 and 11 (2) the provider elects to exercise this health care 12 premium cost-sharing coverage option on behalf of its 13 employees and makes timely payment of the provider's 14 share of the premium. 15 Effective January 1, 2001, if the number of children 16 served by the provider who meet the Illinois Department's 17 child care assistance income guidelines under Article IXA is 18 at least 50% of the enrollment census of the provider, then 19 the provider shall pay 50% of the monthly premiums 20 attributable to the provider's participating employees. 21 Effective July 1, 2001, if the number of children served 22 by the provider who meet the Illinois Department's child care 23 assistance income guidelines under Article IXA is at least 24 40% of the enrollment census of the provider, then the 25 provider shall pay 50% of the monthly premiums attributable 26 to the provider's participating employees. 27 Effective July 1, 2002, if the number of children served 28 by the provider who meet the Illinois Department's child care 29 assistance income guidelines under Article IXA is at least 30 30% of the enrollment census of the provider, then the 31 provider shall pay 50% of the monthly premiums attributable 32 to the provider's participating employees. 33 (c) The Illinois Department shall adopt rules necessary 34 to implement this Section. The rules may include, but need -3- LRB9112675DJcd 1 not be limited to, provisions for enrollment periods and 2 procedures and for the terms, premiums, conditions, 3 limitations, and restrictions of the health care buy-in 4 option under subsection (b).
