91_SB1609 LRB9109996ACtm 1 AN ACT to amend the Emergency Medical Services (EMS) 2 Systems Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Emergency Medical Services (EMS) Systems 6 Act is amended by changing Section 3.155 as follows: 7 (210 ILCS 50/3.155) 8 Sec. 3.155. General Provisions. 9 (a) Authority and responsibility for the EMS System 10 shall be vested in the EMS Resource Hospital, through the EMS 11 Medical Director or his designee. 12 (b) For an inter-hospital emergency or non-emergency 13 medical transport, in which the physician from the sending 14 hospital provides the EMS personnel with written medical 15 orders, such written medical orders cannot exceed the scope 16 of care which the EMS personnel are authorized to render 17 pursuant to this Act. 18 (c) For an inter-hospital emergency or non-emergency 19 medical transport of a patient who requires medical care 20 beyond the scope of care which the EMS personnel are 21 authorized to render pursuant to this Act, a qualified 22 physician, nurse, perfusionist or respiratory therapist 23 familiar with the scope of care needed must accompany the 24 patient and the transferring hospital and physician shall 25 assume medical responsibility for that portion of the medical 26 care. 27 (d) No emergency medical services vehicles or personnel 28 from another State or nation may be utilized on a regular 29 basis to pick up and transport patients within this State 30 without first complying with this Act and all rules adopted 31 by the Department pursuant to this Act. -2- LRB9109996ACtm 1 (e) This Act shall not prevent emergency medical 2 services vehicles or personnel from another State or nation 3 from rendering requested assistance in this State in a 4 disaster situation, or operating from a location outside the 5 State and occasionally transporting patients into this State 6 for needed medical care. Except as provided in Section 31 of 7 this Act, this Act shall not provide immunity from liability 8 for such activities. 9 (f) Except as provided in subsection (e) of this 10 Section, no person or entity shall transport emergency or 11 non-emergency patients by ambulance, SEMSV or medical carrier 12 without first complying with the provisions of this Act and 13 all rules adopted pursuant to this Act. 14 (g) Nothing in this Act or the rules adopted by the 15 Department under this Act shall be construed to authorize any 16 medical treatment to or transportation of any person who 17 objects on religious grounds. 18 (h) A person may not smoke while inside an ambulance, 19 SEMSV, or medical carrier. A violation of this subsection is 20 punishable by a civil penalty of $100. 21 (Source: P.A. 89-177, eff. 7-19-95.)
