1 AN ACT to amend the Consumer Fraud and Deceptive Business
2 Practices Act by adding Section 2KK.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2KK as follows:
7 (815 ILCS 505/2KK new)
8 Sec. 2KK. Merchandise return; cash refund.
9 (a) A person who is engaged in the business of selling
10 merchandise and who accepts returns of merchandise from
11 consumers shall make a cash refund to the consumer at the
12 time the person accepts a return of merchandise if the
13 consumer paid cash at the time the merchandise was purchased.
14 (b) A person who violates this Section commits an
15 unlawful practice within the meaning of this Act.
