91_SB1589enr SB1589 Enrolled LRB9111413NTks 1 AN ACT to amend the Board of Higher Education Act by 2 changing Section 9.24. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Board of Higher Education Act is amended 6 by changing Section 9.24 as follows: 7 (110 ILCS 205/9.24) 8 (Section scheduled to be repealed on December 31, 2000) 9 Sec. 9.24. Sports Equity in Intercollegiate Athletics. 10 For the purpose of attaining gender equity in intercollegiate 11 athletics, public institutions of higher education may grant, 12 in addition to any such amounts previously authorized by the 13 Board, tuition waivers in an amount not to exceed 1% of all 14 tuition income. Intercollegiate athletics, for purposes of 15 this Section, shall include only those sports sanctioned by 16 the National Collegiate Athletic Association and the National 17 Association of Intercollegiate Athletics, but shall not 18 include club sports. 19 Before issuing any such tuition waiver, public 20 institutions of higher education shall place on file with the 21 Board a plan for achieving gender equity in intercollegiate 22 athletics. The plan shall include, but not be limited to: 23 (1) intercollegiate sports opportunities available 24 to both men and women; 25 (2) activities to be undertaken by the institution 26 to achieve gender equity in intercollegiate athletics; 27 (3) identification of the barriers to achieving and 28 maintaining equitable intercollegiate athletic 29 opportunities for men and women; 30 (4) progress in achieving sports equity in 31 compliance with Title IX of the Education Amendments of SB1589 Enrolled -2- LRB9111413NTks 1 1972; and 2 (5) the use of tuition waivers for attaining gender 3 equity in intercollegiate sports. 4 The Board shall report every 32years to the General 5 Assembly and the Governor, on or before the second Wednesday 6 of AprilDecember, beginning in 20021995, with a description 7 of the plans submitted by each public institution of higher 8 education relative to attainment of gender equity in 9 intercollegiate sports. The report shall include financial 10 data on tuition waivers and other intercollegiate athletic 11 expenditures for men and women, the effectiveness of the 12 plans, and the degree of compliance with Title IX of the 13 Higher Education Act of 1965. 14This Section is repealed on December 31, 2000.15 (Source: P.A. 89-166, eff. 7-19-95; 89-626, eff. 8-9-96.) 16 Section 99. Effective date. This Act takes effect upon 17 becoming law.
