91_SB1568 LRB9110342LDpr 1 AN ACT in relation to education funding. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Budget Law of the Civil 5 Administrative Code of Illinois is amended by changing 6 Section 50-20 as follows: 7 (15 ILCS 20/50-20) (was 15 ILCS 20/38.3) 8 Sec. 50-20. Responsible Education Funding Law. 9 (a) The Governor shall submit to the General Assembly a 10 proposed budget for elementary and secondary education in 11 which total General Revenue Fund appropriations are no less 12 than the total General Revenue Fund appropriations of the 13 previous fiscal year. In addition, the Governor shall 14 specify the total amount of funds to be transferred from the 15 General Revenue Fund to the Common School Fund during the 16 budget year, which shall be no less than the total amount 17 transferred during the previous fiscal year. The Governor 18 may submit a proposed budget in which the total appropriated 19 and transferred amounts are less than the previous fiscal 20 year if the Governor declares in writing to the General 21 Assembly the reason for the lesser amounts. 22 (b) The General Assembly shall appropriate amounts for 23 elementary and secondary education from the General Revenue 24 Fund for each fiscal year so that the total General Revenue 25 Fund appropriation is no less than the total General Revenue 26 Fund appropriation for elementary and secondary education for 27 the previous fiscal year. In addition, the General Assembly 28 shall legislatively transfer from the General Revenue Fund to 29 the Common School Fund for the fiscal year a total amount 30 that is no less than the total amount transferred for the 31 previous fiscal year. The General Assembly may appropriate -2- LRB9110342LDpr 1 or transfer lesser amounts if it declares by Joint Resolution 2 the reason for the lesser amounts. 3 (b-5) For the purpose of this Section, moneys 4 appropriated from the General Revenue Fund to the Education 5 Assistance Fund pursuant to subsection (c-10) or (c-20) of 6 Section 13 of the Riverboat Gambling Act shall be considered 7 as moneys dedicated to the Education Assistance Fund and 8 shall not be considered as General Revenue Fund 9 appropriations for elementary and secondary education. 10 (c) This Section may be cited as the Responsible 11 Education Funding Law. 12 (Source: P.A. 91-239, eff. 1-1-00.) 13 Section 99. Effective date. This Act takes effect upon 14 becoming law.
