Amend Senate Bill 1508 by replacing 3 lines 27 through 34 on page 2 and lines 1 through 9 on page 3 4 with the following: 5 "(2) The court shall hold a hearing within 7146 days of the filing of the petition. The People, the 7 petitioner, or the respondent shall be entitled to a 8 continuance of up to 7 days as of right. An additional 9 continuance ofContinuances totalingnot more than 71410 days may be granted to any party (i)the recipientupon a 11 showing that the continuance iscontinuances areneeded 12 in order toprepareadequately prepare for or present 13 evidence in a hearing under this Section or (ii) under 14 exceptional circumstances. The court may, in its15discretion,grant an additional continuance not to exceed 16 21 days when, in its discretion, the court determines 17 that such a continuance is necessary in order to provide 18 the recipient with an examination pursuant to Section 19 3-803 or 3-804 of this Act, to provide the recipient with 20 a trial by jury as provided in Section 3-802 of this Act, 21 or to arrange for the substitution of counsel as provided 22 for by the Illinois Supreme Court Rulescontinuances if23agreed to by all parties. The hearing shall be separate 24 from a judicial proceeding held to determine whether a -2- LRB9112739DJcdam01 1 person is subject to involuntary admission but may be 2 heard immediately preceding or following such a judicial 3 proceeding and may be heard by the same trier of fact or 4 law as in that judicial proceeding.".
