91_SB1415 LRB9111437MWgc 1 AN ACT to amend the Metropolitan Water Reclamation 2 District Act by changing Section 4.32. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Metropolitan Water Reclamation District 6 Act is amended by changing Section 4.32 as follows: 7 (70 ILCS 2605/4.32) (from Ch. 42, par. 323.32) 8 Sec. 4.32. Persons who were engaged in the military or 9 naval service of the United States during the years 1898, 10 1899, 1900, 1901, 1902, 1914, 1915, 1916, 1917, 1918, or 11 1919, any time between September 16, 1940 and July 25, 1947, 12 or any time during the national emergency between June 25, 13 1950 and January 31, 1955, and who were honorably discharged 14 therefrom, and all persons who were engaged in such military 15 or naval service during any of said years, any time between 16 September 16, 1940 and July 25, 1947, or any time during the 17 national emergency between June 25, 1950 and January 31, 18 1955, or any time from August 5, 1964 until the date 19 determined by the Congress of the United States as the end of 20 Viet Nam hostilities, or at any time between August 6, 1990 21 and the date the Persian Gulf Conflict ends as prescribed by 22 Presidential proclamation or order, who are now or may 23 hereafter be on inactive or reserve duty in such military or 24 naval service, not including, however, persons who were 25 convicted by court-martial of disobedience of orders, where 26 such disobedience consisted in the refusal to perform 27 military service on the ground of alleged religious or 28 conscientious objections against war, shall be preferred for 29 appointments to offices, positions and places of employment 30 in the classified service of the District, provided they are 31 found to possess the business capacity necessary for the -2- LRB9111437MWgc 1 proper discharge of the duties of such office, position, or 2 place of employment as determined by examination for original 3 entrance. The Director of Personnel on certifying from any 4 existing register of eligibles resulting from the holding of 5 an examination for original entrance or any register of 6 eligibles that may be hereafter created of persons who have 7 taken and successfully passed the examinations provided for 8 in this Act for original entrance commenced prior to 9 September 1, 1949, shall place the name or names of such 10 persons at the head of any existing eligible register or list 11 of eligibles that shall be created under the provisions of 12 this Act to be certified for appointment. The Director of 13 Personnel shall give preference for original appointment to 14 persons as hereinabove designated whose names appear on any 15 register of eligibles resulting from an examination for 16 original entrance held under the provisions of this Act and 17 commenced on or after September 1, 1949 by adding to the 18 final grade average which they received or will receive as 19 the result of any examination held for original entrance, 20 five points. The numerical result thus attained shall be 21 applied by the Director of Personnel in determining the 22 position of such persons on any eligible list which has been 23 created as the result of any examination for original 24 entrance commenced on or after September 1, 1949 for purposes 25 of preference in certification and appointment from such 26 eligible list. 27 Every certified Civil Service employee who was called to, 28 or who volunteered for, the military or naval service of the 29 United States at any time during the years specified in this 30 Act, or at any time between September 16, 1940 and July 25, 31 1947 or any time during the national emergency between June 32 25, 1950 and January 31, 1955, or any time from August 5, 33 1964 until the date determined by Congress of the United 34 States as the end of Viet Nam hostilities, or at any time -3- LRB9111437MWgc 1 between August 6, 1990 and the date the Persian Gulf conflict 2 ends as prescribed by Presidential proclamation or order, and 3 who were honorably discharged therefrom or who are now or who 4 may hereafter be on inactive or reserve duty in such military 5 or naval service, not including, however, persons who were 6 convicted by court martial of disobedience of orders where 7 such disobedience consisted in the refusal to perform 8 military service on the ground of alleged religious or 9 conscientious objections against war, and whose names appear 10 on existing promotional eligible registers or any promotional 11 eligible register that may hereafter be created, as provided 12 for by this Act, shall be preferred for promotional 13 appointment to civil offices, positions and places of 14 employment in the classified civil service of the District 15 coming under the provisions of this Act. 16 The Director of Personnel shall give preference for 17 promotional appointment to persons as hereinabove designated 18 whose names appear on existing promotional eligible registers 19 or promotional eligible registers that may hereafter be 20 created by adding to the final grade average which they 21 received or will receive as the result of any promotional 22 examination commencing prior to September 1, 1949 23 three-fourths of one point for each 6 months or fraction 24 thereof of military or naval service not exceeding 48 25 months;, andby adding to the final grade average which they 26 will receive as the result of any promotional examination 27 held commencing on or after September 1, 1949 and before 28 January 1, 2001 seven-tenths of one point for each 6 months 29 or fraction thereof of military or naval service not 30 exceeding 30 months; and by adding 5 points to the final 31 grade average that they will receive as the result of any 32 promotional examination held on or after January 1, 2001. The 33 numerical result thus attained shall be applied by the 34 Director of Personnel in determining the position of such -4- LRB9111437MWgc 1 persons on any eligible list which has been created or will 2 be created as the result of any promotional examination held 3 hereunder for purposes of preference in certification and 4 appointment from such eligible list. 5No person shall receive the preference for a promotional6appointment granted by this Section after he has received one7promotion from an eligible list on which he was allowed such8preference and which was prepared as a result of an9examination held on or after September 1, 1949.10No person entitled to preference or credit for military11or naval service hereunder shall be required to furnish12evidence or record of honorable discharge from the armed13forces before any examination held under the provisions of14this Act but such preference shall be given after the posting15or publication of the eligible list or register and before16any certification or appointments are made from the eligible17register.18 (Source: P.A. 86-324; 87-945.) 19 Section 99. Effective date. This Act takes effect on 20 January 1, 2001.
