 1        AN  ACT  to  amend  the  Criminal  Code of 1961 by adding
 2    Section 24-10.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.  The  Criminal  Code  of  1961  is amended by
 6    adding Section 24-10 as follows:

 7        (720 ILCS 5/24-10 new)
 8        Sec. 24-10.  Resale of law  enforcement  agency  firearms
 9    prohibited.
10        (a)  A  law  enforcement agency of the State or a unit of
11    local government may not transfer a decommissioned firearm to
12    any person.
13        (b)  A law enforcement agency of the State or a  unit  of
14    local government must destroy or order the destruction of all
15    decommissioned firearms under its jurisdiction.
16        (c)  This Section does not apply to:
17             (1)  The  transfer  of  a  decommissioned firearm to
18        another law enforcement agency.
19             (2)  The transfer of a decommissioned firearm  to  a
20        law  enforcement  training  agency  or  to  an officer or
21        employee of a correctional institution for official use.
22        (d)  In this Section:
23             (1)  "Decommissioned firearm" means a firearm that:
24                  (A)  has been used by a law enforcement  agency
25             and  is  no  longer  in  service  or  use by the law
26             enforcement agency; or
27                  (B)  has  been  used  or   possessed   in   the
28             commission of a crime, has been confiscated, has not
29             been  returned to a rightful owner, and is no longer
30             needed for evidentiary purposes.
31             (2)  "Law enforcement agency" means an agency of the

 1        State or unit of local government that is invested by law
 2        or ordinance with the duty to maintain public order, make
 3        arrests, and to enforce criminal laws and ordinances.
