Amend Senate Bill 1393 as follows: 3 on page 10, by replacing lines 22 through 34 with the 4 following: 5 "(d) Chronic obstruction of a grade crossing. Within the 6 Chicago switching district, the Commission may, after 7 investigation, make a determination that a railroad has 8 engaged in chronic obstruction of a grade crossing. The 9 Commission shall investigate allegations that a railroad's 10 trains repeatedly and with great rate of recurrence obstruct 11 a grade crossing by frequently stopping and causing 12 disruption of vehicular traffic and endangering the lives and 13 safety of the citizens of this State by interfering with the 14 operation of ambulances and fire department vehicles. The 15 Commission shall find that chronic obstruction of a grade 16 crossing has occurred if, within a 2-week period, a 17 railroad's trains have stopped traffic at that crossing for 18 20 minutes or longer 3 or more times. Once a railroad is 19 designated as chronically obstructing a grade crossing, the 20 Commission shall forward the results of the investigation to 21 the State's Attorney, of the county where the crossing is 22 located, for prosecution. The penalty for obstructing that 23 grade crossing is a Class C misdemeanor for the first -2- LRB9111145DHmbam03 1 offense."; and 2 on page 11, by deleting line 1; and 3 on page 15, by replacing lines 6 through 19 with the 4 following: 5 "(d) Chronic obstruction of a grade crossing.
