91_SB1391sam001 LRB9112340ACfgam01 1 AMENDMENT TO SENATE BILL 1391 2 AMENDMENT NO. ____. Amend Senate Bill 1391 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Environmental Protection Act is amended 5 by adding Section 10.1 as follows: 6 (415 ILCS 5/10.1 new) 7 Sec. 10.1. Limestone quarry operation; fugitive dust 8 control plan; rules. 9 (a) The Agency shall publish notice of and hold a 10 hearing, pursuant to Section 252 of Title 35 of the Illinois 11 Administrative Code, on an application for an air pollution 12 control permit for a crushed and broken limestone quarry 13 operation in the PM10 nonattainment area, as defined in 14 Section 212.324 of Title 35 of the Illinois Administrative 15 Code. 16 The Agency shall also provide public notice of and make 17 available for public comment at the hearing a fugitive dust 18 control plan required pursuant to Section 212.309 of Title 35 19 of the Illinois Administrative Code for any source for which 20 a hearing is required under this Section. The Agency must 21 approve or deny the fugitive dust control plan based on 22 criteria established by Board rule. -2- LRB9112340ACfgam01 1 (b) Within 60 days after the effective date of this 2 Section, the Agency shall review existing rules relating to 3 fugitive dust control plans and propose to the Board 4 additional rules specifying in detail the required contents 5 of those plans. At a minimum, the rules shall (i) require 6 that a fugitive dust control plan provide stringent 7 safeguards to protect the life, health, safety, and comfort 8 of the residents of areas surrounding a crushed and broken 9 limestone quarry operation and (ii) include a procedure under 10 which the permittee is required to accept and respond to 11 public comment and address public concerns relating to 12 fugitive dust control throughout the term of the permit. The 13 Board shall consider and adopt the proposed rules as 14 expeditiously as may be practical. 15 Section 99. Effective date. This Act takes effect upon 16 becoming law.".
