91_SB1368 LRB9111036NTsb 1 AN ACT to amend the School Code by changing Sections 2 2-3.53, 21-7.1, and 21-16. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Code is amended by changing 6 Sections 2-3.53, 21-7.1, and 21-16 as follows: 7 (105 ILCS 5/2-3.53) (from Ch. 122, par. 2-3.53) 8 Sec. 2-3.53. Administrators' Academy. The State Board 9 of Education shall cause to be established an Illinois 10 Administrators' Academy. This Academy shall develop programs 11 thatwhichprovide for development of skills in the areas of 12 instructional staff development, school improvement, school 13 accountability, effective communication skills, public school 14 relations, evaluation of personnel, including documentation 15 of employee performance and remediation of unsatisfactory 16 employee performance. 17 By January 1, 1986, the State Board of Education shall 18 establish a schedule by which administrators throughout 19 Illinois must receive training through the Academy. 20 (Source: P.A. 87-1076.) 21 (105 ILCS 5/21-7.1) (from Ch. 122, par. 21-7.1) 22 Sec. 21-7.1. Administrative certificate. 23 (a) After July 1, 1999, an administrative certificate 24 valid for 5 years of supervising and administering in the 25 public common schools may be issued to persons who have 26 graduated from a regionally accredited institution of higher 27 learning with a master's degree and who have been recommended 28 by a recognized institution of higher learning as having 29 completed a program of preparation for one or more of these 30 endorsements. TheseSuchprograms of academic and -2- LRB9111036NTsb 1 professional preparation required for endorsement shall be 2 administered by the institution in accordance with standards 3 set forth by the State Superintendent of Education in 4 consultation with the State Teacher Certification Board. 5 (b) No administrative certificate shall be issued for 6 the first time after June 30, 1987 and no endorsement 7 provided for by this Section shall be made or affixed to an 8 administrative certificate for the first time after June 30, 9 1987 unless the person to whom such administrative 10 certificate is to be issued or to whose administrative 11 certificate such endorsement is to be affixed has been 12 required to demonstrate as a part of a program of academic or 13 professional preparation for such certification or 14 endorsement: (i) an understanding of the knowledge called for 15 in establishing productive parent-school relationships and of 16 the procedures fostering the involvement which such 17 relationships demand; and (ii) an understanding of the 18 knowledge required for establishing a high quality school 19 climate and promoting good classroom organization and 20 management, including rules of conduct and instructional 21 procedures appropriate to accomplishing the tasks of 22 schooling; and (iii) a demonstration of the knowledge and 23 skills called for in providing instructional leadership. The 24 standards for demonstrating an understanding of such 25 knowledge shall be set forth by the State Board of Education 26 in consultation with the State Teacher Certification Board, 27 and shall be administered by the recognized institutions of 28 higher learning as part of the programs of academic and 29 professional preparation required for certification and 30 endorsement under this Section. As used in this subsection: 31 "establishing productive parent-school relationships" means 32 the ability to maintain effective communication between 33 parents and school personnel, to encourage parental 34 involvement in schooling, and to motivate school personnel to -3- LRB9111036NTsb 1 engage parents in encouraging student achievement, including 2 the development of programs and policies which serve to 3 accomplish this purpose; and "establishing a high quality 4 school climate" means the ability to promote academic 5 achievement, to maintain discipline, to recognize substance 6 abuse problems among students and utilize appropriate law 7 enforcement and other community resources to address these 8 problems, to support teachers and students in their education 9 endeavors, to establish learning objectives and to provide 10 instructional leadership, including the development of 11 policies and programs which serve to accomplish this purpose; 12 and "providing instructional leadership" means the ability to 13 effectively evaluate school personnel, to possess general 14 communication and interpersonal skills, and to establish and 15 maintain appropriate classroom learning environments. The 16 provisions of this subsection shall not apply to or affect 17 the initial issuance or making on or before June 30, 1987 of 18 any administrative certificate or endorsement provided for 19 under this Section, nor shall such provisions apply to or 20 affect the renewal after June 30, 1987 of any such 21 certificate or endorsement initially issued or made on or 22 before June 30, 1987. 23 (c) Administrative certificates shall be renewed every 24 five years with the first renewal being five years following 25 the initial receipt of an administrative certificate. Renewal 26 requirements for administrators whose positions require 27 certification shall be based upon evidence of continuing 28 professional education which promotes the following goals: 29 (1) Improving administrators' knowledge of instructional 30 practices and administrative procedures; (2) Maintaining the 31 basic level of competence required for initial certification; 32 and (3) Improving the mastery of skills and knowledge 33 regarding the improvement of teaching performance in clinical 34 settings and assessment of the levels of student performance -4- LRB9111036NTsb 1 in their schools. Evidence of continuing professional 2 education must include verification of biennial attendance in 3 a program developed by the Illinois Administrators' Academy 4 and verification of annual participation in a school district 5 approved activity which contributes to continuing 6 professional education. The State Board of Education, in 7 consultation with the State Teacher Certification Board, 8 shall develop procedures for implementing this Section and 9 shall administer the renewal of administrative certificates. 10 Failure to submit satisfactory evidence of continuing 11 professional education which contributes to promoting the 12 goals of this Section shall result in a loss of 13 administrative certification. 14 (d) Any limited or life supervisory certificate issued 15 prior to July 1, 1968 shall continue to be valid for all 16 administrative and supervisory positions in the public 17 schools for which it is valid as of that date as long as its 18 holder meets the requirements for registration or renewal as 19 set forth in the statutes or until revoked according to law. 20 (e) The administrative or supervisory positions for 21 which the certificate shall be valid shall be determined by 22 one or more of 3 endorsements: general supervisory, general 23 administrative and superintendent. 24 Subject to the provisions of Section 21-1a, endorsements 25 shall be made under conditions set forth in this Section. 26 The State Board of Education shall, in consultation with the 27 State Teacher Certification Board, adopt rules pursuant to 28 the Illinois Administrative Procedure Act, establishing 29 requirements for obtaining administrative certificates where 30 the minimum administrative or supervisory requirements 31 surpass those set forth in this Section. 32 The State Teacher Certification Board shall file with the 33 State Board of Education a written recommendation when 34 considering additional administrative or supervisory -5- LRB9111036NTsb 1 requirements. All additional requirements shall be based 2 upon the requisite knowledge necessary to perform those tasks 3 required by the certificate. The State Board of Education 4 shall in consultation with the State Teacher Certification 5 Board, establish standards within its rules which shall 6 include the academic and professional requirements necessary 7 for certification. These standards shall at a minimum 8 contain, but not be limited to, those used by the State Board 9 of Education in determining whether additional knowledge will 10 be required. Additionally, the State Board of Education 11 shall in consultation with the State Teacher Certification 12 Board, establish provisions within its rules whereby any 13 member of the educational community or the public may file a 14 formal written recommendation or inquiry regarding 15 requirements. 16 (1) Until July 1, 2003, the general supervisory 17 endorsement shall be affixed to the administrative 18 certificate of any holder who has at least 16 semester 19 hours of graduate credit in professional education 20 including 8 semester hours of graduate credit in 21 curriculum and research and who has at least 2 years of 22 full-time teaching experience or school service personnel 23 experience in public schools, schools under the 24 supervision of the Department of Corrections, schools 25 under the administration of the Department of 26 Rehabilitation Services, or nonpublic schools meeting the 27 standards established by the State Superintendent of 28 Education or comparable out-of-state recognition 29 standards approved by the State Superintendent of 30 Education. 31 Such endorsement shall be required for supervisors, 32 curriculum directors and for such similar and related 33 positions as determined by the State Superintendent of 34 Education in consultation with the State Teacher -6- LRB9111036NTsb 1 Certification Board. 2 (2) The general administrative endorsement shall be 3 affixed to the administrative certificate of any holder 4 who has at least 20 semester hours of graduate credit in 5 educational administration and supervision and who has at 6 least 2 years of full-time teaching experience or school 7 service personnel experience in public schools, schools 8 under the supervision of the Department of Corrections, 9 schools under the administration of the Department of 10 Rehabilitation Services, or nonpublic schools meeting the 11 standards established by the State Superintendent of 12 Education or comparable out-of-state recognition 13 standards approved by the State Superintendent of 14 Education. 15 Such endorsement shall be required for principal, 16 assistant principal, assistant or associate 17 superintendent, junior college dean and for related or 18 similar positions as determined by the State 19 Superintendent of Education in consultation with the 20 State Teacher Certification Board. 21 Notwithstanding any other provisions of this Act, 22 after January 1, 1990 and until January 1, 1991, any 23 teacher employed by a district subject to Article 34 24 shall be entitled to receive an administrative 25 certificate with a general administrative endorsement 26 affixed thereto if he or she: (i) had at least 3 years of 27 experience as a certified teacher for such district prior 28 to August 1, 1985; (ii) obtained a Master's degree prior 29 to August 1, 1985; (iii) completed at least 20 hours of 30 graduate credit in education courses (including at least 31 12 hours in educational administration and supervision) 32 prior to September 1, 1987; and (iv) has received a 33 rating of superior for at least each of the last 5 years. 34 Any person who obtains an administrative certificate with -7- LRB9111036NTsb 1 a general administrative endorsement affixed thereto 2 under this paragraph shall not be qualified to serve in 3 any administrative position except assistant principal. 4 (3) The chief school business official endorsement 5 shall be affixed to the administrative certificate of any 6 holder who qualifies by having a Master's degree, two 7 years of administrative experience in school business 8 management, and a minimum of 20 semester hours of 9 graduate credit in a program established by the State 10 Superintendent of Education in consultation with the 11 State Teacher Certification Board for the preparation of 12 school business administrators. Such endorsement shall 13 also be affixed to the administrative certificate of any 14 holder who qualifies by having a Master's Degree in 15 Business Administration, Finance or Accounting from a 16 regionally accredited institution of higher education. 17 After June 30, 1977, such endorsement shall be 18 required for any individual first employed as a chief 19 school business official. 20 (4) The superintendent endorsement shall be affixed to 21 the administrative certificate of any holder who has 22 completed 30 semester hours of graduate credit beyond the 23 master's degree in a program for the preparation of 24 superintendents of schools including 16 semester hours of 25 graduate credit in professional education and who has at 26 least 2 years experience as an administrator or supervisor in 27 the public schools or the State Board of Education or 28 education service regions or in nonpublic schools meeting the 29 standards established by the State Superintendent of 30 Education or comparable out-of-state recognition standards 31 approved by the State Superintendent of Education and holds 32 general supervisory or general administrative endorsement, or 33 who has had 2 years of experience as a supervisor or 34 administrator while holding an all-grade supervisory -8- LRB9111036NTsb 1 certificate or a certificate comparable in validity and 2 educational and experience requirements. 3 After June 30, 1968, such endorsement shall be required 4 for a superintendent of schools, except as provided in the 5 second paragraph of this Section and in Section 34-6. 6 Any person appointed to the position of superintendent 7 between the effective date of this Act and June 30, 1993 in a 8 school district organized pursuant to Article 32 with an 9 enrollment of at least 20,000 pupils shall be exempt from the 10 provisions of this Subsection (4) until June 30, 1996. 11 (f) All official interpretations or acts of issuing or 12 denying administrative certificates or endorsements by the 13 State Teacher's Certification Board, State Board of Education 14 or the State Superintendent of Education, from the passage of 15 P.A. 81-1208 on November 8, 1979 through September 24, 1981 16 are hereby declared valid and legal acts in all respects and 17 further that the purported repeal of the provisions of this 18 Section by P.A. 81-1208 and P.A. 81-1509 is declared null and 19 void. 20 (Source: P.A. 91-102, eff. 7-12-99.) 21 (105 ILCS 5/21-16) (from Ch. 122, par. 21-16) 22 Sec. 21-16. Fees - Requirement for registration. 23 (a) Until February 15, 2000, every applicant when issued 24 a certificate shall pay to the regional superintendent of 25 schools a fee of $1, which shall be paid into the institute 26 fund. Every certificate issued under the provisions of this 27 CodeActshall be registered annually or, at the option of 28 the holder of the certificate, once every 3 years. The 29 regional superintendent of schools having supervision and 30 control over the school where the teaching is done shall 31 register the certificate before the holder begins to teach, 32 otherwise it shall be registered in any county in the State 33 of Illinois; and one fee of $4 per year for registration or -9- LRB9111036NTsb 1 renewal of one or more certificates which have been issued to 2 the same holder shall be paid into the institute fund. 3 Until February 15, 2000, requirements for registration of 4 any certificate limited in time shall include evidence of 5 professional growth defined as successful teaching experience 6 since last registration of certificate, attendance at 7 professional meetings, membership in professional 8 organizations, additional credits earned in recognized 9 teacher-training institutions, travel specifically for 10 educational experience, reading of professional books and 11 periodicals, filing all reports as required by the regional 12 superintendent of schools and the State Superintendent of 13 Education or such other professional experience or 14 combination of experiences as are presented by the teacher 15 and are approved by the State Superintendent of Education in 16 consultation with the State Teacher Certification Board. A 17 duplicate certificate may be issued to the holder of a valid 18 life certificate or valid certificate limited in time by the 19 State Superintendent of Education; however, it shall only be 20 issued upon request of a regional superintendent of schools 21 and upon payment to the regional superintendent of schools 22 who requests such duplicate a fee of $4. 23 (b) Beginning February 15, 2000, all persons who are 24 issued Standard Teaching Certificates pursuant clause (2) of 25 subsection (c) of Section 21-2 and all persons who renew 26 Standard Teaching Certificates shall pay a $25 fee for 27 registration of all certificates held. All persons who are 28 issued Standard Teaching Certificates under clause (1) of 29 subsection (c) of Section 21-2 and all other applicants for 30 Standard Teaching Certificates shall pay an original 31 application fee, pursuant to Section 21-12, and a $25 fee for 32 registration of all certificates held. These certificates 33 shall be registered and the registration fee paid once every 34 5 years. Standard Teaching Certificate applicants and -10- LRB9111036NTsb 1 holders shall not be required to pay any other registration 2 fees for issuance or renewal of their certificates, except as 3 provided in Section 21-17 of this Code. Beginning February 4 15, 2000, Master Teaching Certificates shall be issued and 5 renewed upon payment by the applicant or certificate holder 6 of a $50 fee for registration of all certificates held. 7 These certificates shall be registered and the fee paid once 8 every 10 years. Master Teaching Certificate applicants and 9 holders shall not be required to pay any other application or 10 registration fees for issuance or renewal of their 11 certificates, except as provided in Section 21-17 of this 12 Code. All other certificates issued under the provisions of 13 this Code shall be registered for the validity period of the 14 certificate at the rate of $5 per year for the total number 15 of years for which the certificate is valid for registration 16 of all certificates held, or for a maximum of 5 years for 17 life certificates. The regional superintendent of schools 18 having supervision and control over the school where the 19 teaching is done shall register the certificate before the 20 holder begins to teach, otherwise it shall be registered in 21 any county in the State of Illinois. Each holder shall pay 22 the appropriate registration fee to the regional 23 superintendent of schools. The regional superintendent of 24 schools shall deposit the registration fees into the 25 institute fund. Any certificate holder who teaches in more 26 than one educational service region shall register the 27 certificate or certificates in all regions where the teaching 28 is done, but shall be required to pay one registration fee 29 for all certificates held, provided holders of certificates 30 issued pursuant to Section 21-9 of this Code shall be 31 required to pay one registration fee, in each educational 32 service region in which his or her certificate or 33 certificates are registered, for all certificates held. 34 A duplicate certificate may be issued to the holder of a -11- LRB9111036NTsb 1 valid life certificate or valid certificate limited in time 2 by the State Superintendent of Education; however, it shall 3 only be issued upon request of a regional superintendent of 4 schools and upon payment to the regional superintendent of 5 schools who requests the duplicate a fee of $4, which shall 6 be deposited into the institute fund. 7 (Source: P.A. 91-102, eff. 7-12-99.)
