91_SB1291enr SB1291 Enrolled LRB9109869REmb 1 AN ACT to amend the Department of Transportation Law of 2 the Civil Administrative Code of Illinois by changing Section 3 2705-555. 4 Be it enacted by the People of the State of Illinois, 5 represented in the General Assembly: 6 Section 5. The Department of Transportation Law of the 7 Civil Administrative Code of Illinois is amended by changing 8 Section 2705-555 as follows: 9 (20 ILCS 2705/2705-555) (was 20 ILCS 2705/49.13) 10 Sec. 2705-555. Lease of land or property. 11 (a) The Department has the power from time to time to 12 lease any land or property, with or without appurtenances, of 13 which the Department has jurisdiction and that is not 14 immediately to be used or developed by the State; provided 15 that no such lease be for a longer period of time than that 16 in which it can reasonably be expected the State will not 17 have use for the property, and further provided that no such 18 lease be for a longer period of time than 5 years, except as 19 provided in subsection (b). 20 (b) In counties with a population of not less than 21 500,000 and not more than 800,000, a lease to any other 22 department of State government, any authority, commission, or 23 agency of the State, or a municipality, county, or township 24 of the State, including in any land lease the corresponding 25 vertical rights, subterranean and air rights, and sublease 26 rights, may be for a period of time no longer than 25 years. 27 (Source: P.A. 91-239, eff. 1-1-00.) 28 Section 99. Effective date. This Act takes effect upon 29 becoming law.
