91_SB1180 LRB9103487REpk 1 AN ACT to amend the Legislative Commission Reorganization 2 Act of 1984 by changing Section 1-5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Legislative Commission Reorganization Act 6 of 1984 is amended by changing Section 1-5 as follows: 7 (25 ILCS 130/1-5) (from Ch. 63, par. 1001-5) 8 Sec. 1-5. Composition of agencies; directors. 9 (a)(1) Each legislative support services agency listed 10 in Section 1-3 is hereafter in this Section referred to as 11 the Agency. 12 (2) The Citizens Assembly shall consist of the 14 13 co-chairpersons of the Citizens Councils created under 14 Article 11A. 15 (2.1) The Pension Laws Commission shall consist of 8 16 members of the General Assembly, of whom 2 shall be appointed 17 by the President of the Senate, 2 shall be appointed by the 18 Minority Leader of the Senate, 2 shall be appointed by the 19 Speaker of the House of Representatives, and 2 shall be 20 appointed by the Minority Leader of the House of 21 Representatives; plus 8 public members with knowledge of 22 privately funded and operated pension plans, of whom 2 shall 23 be appointed by the President of the Senate, 2 shall be 24 appointed by the Minority Leader of the Senate, 2 shall be 25 appointed by the Speaker of the House of Representatives, and 26 2 shall be appointed by the Minority Leader of the House of 27 Representatives. All appointments shall be in writing and 28 filed with the Secretary of State as a public record. 29 Legislative members of the Pension Laws Commission shall 30 be appointed during the month of January in each odd-numbered 31 year for 2-year terms beginning February 1. Any vacancy on -2- LRB9103487REpk 1 the Commission shall be filled by appointment for the balance 2 of the term in the same manner as the original appointment. 3 A vacancy exists when a legislative member ceases to hold the 4 elected legislative office held at the time of appointment. 5 The initial legislative members of the Commission shall be 6 appointed as soon as practicable after the effective date of 7 this amendatory Act and shall serve until January 31, 1997. 8 (3) The other legislative support services agencies 9 shall each consist of 12 members of the General Assembly, of 10 whom 3 shall be appointed by the President of the Senate, 3 11 shall be appointed by the Minority Leader of the Senate, 3 12 shall be appointed by the Speaker of the House of 13 Representatives, and 3 shall be appointed by the Minority 14 Leader of the House of Representatives. All appointments 15 shall be in writing and filed with the Secretary of State as 16 a public record. 17 Members shall serve a two year term, and must be 18 appointed by the Joint Committee during the month of January 19 in each odd-numbered year for terms beginning February 1. 20 Any vacancy in an Agency shall be filled by appointment for 21 the balance of the term in the same manner as the original 22 appointment. A vacancy shall exist when a member no longer 23 holds the elected legislative office held at the time of the 24 appointment or at the termination of the member's legislative 25 service. 26 (b) (Blank). 27 (c) Every two years the members of each Agency shall 28 elect, during the month of February of each odd-numbered 29 year, 2 co-chairmen and such other officers as they deem 30 necessary. If members of the Agency cannot agree on the 31 co-chairmen by March 1 of the odd-numbered year, the 32 co-chairmen shall be selected from among the members by the 33 Joint Committee on Legislative Support Services. The 34 co-chairmen of each Agency shall serve for a two-year term, -3- LRB9103487REpk 1 beginning February 1 of the odd-numbered year, and the 2 2 co-chairmen shall not be members of or identified with the 3 same house or the same political party. If a co-chairman of 4 the Citizens Assembly is not a member of the General 5 Assembly, he shall be considered to be identified with the 6 house and the political party of the legislative leader by 7 whom he was appointed. The co-chairmen of the Pension Laws 8 Commission shall be legislative members of the Commission. 9 Each Agency shall meet twice annually or more often upon 10 the call of the chair or any 9 members. A quorum of the 11 Agency shall consist of a majority of the appointed members. 12 (d) Members of each Agency shall serve without 13 compensation, but shall be reimbursed for expenses incurred 14 in carrying out the duties of the Agency pursuant to rules 15 and regulations adopted by the Joint Committee on Legislative 16 Support Services. 17 (e) Beginning February 1, 1985, and every two years 18 thereafter, the Joint Committee shall select an Executive 19 Director who shall be the chief executive officer and staff 20 director of each Agency. The Executive Director shall 21 receive a salary as fixed by the Joint Committee and, in 22 addition, shall receive an annual cost of living adjustment 23 effective each July 1. The cost of living adjustment shall 24 equal the lesser of 5% of the Executive Director's salary or 25 the cost of living index known as the "Employment Cost Index, 26 Wages and Salaries, by Occupation and Industry Group: State 27 and Local Government Workers: Public Administration", as 28 published by the United States Department of Labor, Bureau of 29 Labor Statistics, applicable for the calendar year 30 immediately preceding the calendar year in which the 31 respective July 1st increase is scheduled. The Executive 32 Directorandshall be authorized to employ and fix the 33 compensation of necessary professional, technical and 34 secretarial staff and prescribe their duties, sign contracts, -4- LRB9103487REpk 1 and issue vouchers for the payment of obligations pursuant to 2 rules and regulations adopted by the Joint Committee on 3 Legislative Support Services. The Executive Director and 4 other employees of the Agency shall not be subject to the 5 Personnel Code. 6 (Source: P.A. 89-113, eff. 7-7-95.) 7 Section 99. Effective date. This Act takes effect upon 8 becoming law.
