Amend Senate Bill 1174 on page 4, 3 line 5 by deleting "layoffs, reorganizations,"; and 4 on page 6, by inserting after line 15 the following: 5 "(6) Notify the Department 30 days before effecting 6 any layoff. Once notice is given, the following shall 7 occur: 8 (a) No layoff may be effective earlier than 10 9 working days after notice to the Department, unless 10 an emergency layoff situation exists. 11 (b) The State executive department, State 12 agency, board, commission, or instrumentality in 13 which the layoffs are to occur must notify each 14 employee targeted for layoff, the employee's union 15 representative (if applicable), and the State 16 Dislocated Worker Unit at the Department of Commerce 17 and Community Affairs. 18 (c) The State executive department, State 19 agency, board, commission, or instrumentality in 20 which the layoffs are to occur must conform to 21 applicable collective bargaining agreements. 22 (d) The State executive department, State 23 agency, board, commission, or instrumentality in -2- LRB9106029WHdvam01 1 which the layoffs are to occur should notify each 2 employee targeted for layoff that transitional 3 assistance may be available to him or her under the 4 Economic Dislocation and Worker Adjustment 5 Assistance Act administered by the Department of 6 Commerce and Community Affairs. Failure to give 7 such notice shall not invalidate the layoff or 8 postpone its effective date.".
