1 AMENDMENT TO SENATE BILL 1171
2 AMENDMENT NO. . Amend Senate Bill 1171 on page 10,
3 line 25, by replacing "both" with "all both"; and
4 on page 10, line 27, by replacing "notice" with "Notice to
5 Remediate"; and
6 on page 11, below line 12, by inserting the following:
7 "(3) Cause to be recorded the Notice to Remediate
8 mailed under paragraph (1) in the office of the recorder
9 in the county in which the real estate is located or in
10 the office of the registrar of titles of the county if
11 the real estate is registered under the Registered Title
12 (Torrens) Act."; and
13 on page 12, by replacing lines 16 through 19 with "repair,
14 enclosure, or removal within 180 days after the repair,
15 demolition, enclosure, or removal occurred,"; and
16 on page 12, line 24, by replacing "Act." with "Act; this lien
17 has priority over the interests of those parties named in the
18 Notice to Remediate mailed under paragraph (1), but not over
19 the interests of third party purchasers or encumbrancers for
20 value who obtained their interests in the property before
21 obtaining actual or constructive notice of the lien.".
