91_SB1160 LRB9105977NTsb 1 AN ACT to amend the Illinois Mathematics and Science 2 Academy Law by changing Section 4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Mathematics and Science Academy 6 Law is amended by changing Section 4 as follows: 7 (105 ILCS 305/4) (from Ch. 122, par. 1503-4) 8 Sec. 4. Powers of the Board. The board is hereby 9 authorized to: 10 (a) Accept donations, bequests, or other forms of 11 financial assistance for educational purposes from any public 12 or private person or agency and comply with rules and 13 regulations governing grants from the federal government or 14 from any other person or agency, which are not in 15 contravention of the Illinois Constitution or the laws of the 16 State of Illinois. 17 (b) Purchase equipment and make improvements to 18 facilities necessary for the use of the school, in accordance 19 with applicable law. 20 (c) Adopt, amend, or repeal rules, regulations, and 21 policies necessary or proper for the conduct of the business 22 of the board. 23 (d) Award certificates and issue diplomas for successful 24 completion of programs of study requirements. 25 (e) Select a Director who shall be the chief 26 administrative officer of the Academy and who shall 27 administer the rules, regulations, and policies adopted by 28 the Board pursuant hereto. The Director shall also be the 29 chief administrative officer of the Board and shall be 30 responsible for all the administrative functions, duties, and 31 needs of the Board. -2- LRB9105977NTsb 1 (f) Determine faculty and staff positions necessary for 2 the efficient operation of the school and select personnel 3 for such positions. 4 (g) Prepare and adopt an annual budget necessary for the 5 continued operation of the school. 6 (h) Enter into contracts and agreements which have been 7 recommended by the Director, in accordance with applicable 8 law, and to the extent that funds are specifically 9 appropriated therefor, with other public agencies with 10 respect to cooperative enterprises and undertaking related to 11 or associated with an educational purpose or program 12 affecting education in the school. This shall not preclude 13 the Board from entering into other such contracts and 14 agreements that it may deem necessary to carry out its duties 15 and functions. 16 (i) Perform such other functions as are necessary to the 17 supervision and control of those phases of education under 18 its supervision and control. 19 (j) The Board shall delegate to the Director such of its 20 administrative powers and duties as it deems appropriate to 21 aid the Director in the efficient administration of his 22 responsibility for the implementation of the policies of the 23 Board. 24 (k) The Academy shall be empowered to lease or purchase 25 real and personal property on commercially reasonable terms 26 for the use of the Academy. After July 1, 1988, any leases 27 or purchases of real or personal property and any disposition 28 thereof by the Academy must be in compliance with the 29 provisions of The Civil Administrative Code of Illinois and 30 the State Property Control Act. Personal property acquired 31 for the use of the Academy shall be inventoried and disposed 32 of in accordance with the State Property Control Act. 33 In addition to the authorities granted herein and any 34 powers, duties, and responsibilities vested by any other -3- LRB9105977NTsb 1 applicable laws, the Board shall: 2 (1) Adopt rules, regulations, and policies 3 necessary for the efficient operation of the school. 4 (2) Establish criteria to be used in determining 5 eligibility of applicants for enrollment. Such criteria 6 shall apply to each region in Illinois to ensure adequate 7 geographic, sexual, and ethnic representation. The State 8 shall be divided into 7 regions, with each region being 9 comprised of multiple counties. Region No. 1 counties 10 are Boone, Bureau, Carroll, DeKalb, Grundy, Henry, 11 JoDaviess, LaSalle, Lee, Mercer, Ogle, Putnam, Rock 12 Island, Stephenson, Whiteside, and Winnebago. Region No. 13 2 counties are Adams, Brown, Calhoun, Cass, Fulton, 14 Greene, Hancock, Henderson, Jersey, Knox, McDonough, 15 Morgan, Pike, Schuyler, Scott, and Warren. Region No. 3 16 counties are Christian, DeWitt, Livingston, Logan, Macon, 17 Macoupin, Marshall, Mason, McLean, Menard, Montgomery, 18 Moultrie, Peoria, Piatt, Sangamon, Shelby, Stark, 19 Tazewell, and Woodford. Region No. 4 counties are 20 Champaign, Clark, Coles, Cumberland, Douglas, Edgar, 21 Ford, Iroquois, Kankakee, and Vermilion. Region No. 5 22 counties are Madison, Monroe, and St. Clair. Region No. 23 6 counties are Alexander, Bond, Clay, Clinton, Crawford, 24 Edwards, Effingham, Fayette, Franklin, Gallatin, 25 Hamilton, Hardin, Jackson, Jasper, Jefferson, Johnson, 26 Lawrence, Marion, Massac, Perry, Pope, Pulaski, Randolph, 27 Richland, Saline, Union, Wabash, Washington, Wayne, 28 White, and Williamson. Region No. 7 counties are Cook, 29 DuPage, Kane, Kendall, Lake, McHenry, and Will. 30 (3) Determine subjects and extracurricular 31 activities to be offered. 32 (4) Pay salaries and expenses, including but not 33 necessarily restricted to facilities, equipment, and 34 supplies of the faculty and staff of the Academy out of -4- LRB9105977NTsb 1 funds appropriated or otherwise made available for the 2 operating and administrative expenses of the Board and 3 the Academy. 4 (5) Exercise budgetary responsibility and allocate 5 for expenditure by the Academy and programs under its 6 jurisdiction, all monies appropriated or otherwise made 7 available for purposes of the Board and of such Academy 8 and programs. 9 (6) Prescribe and select for use in the school free 10 school books and other materials of instruction for 11 children enrolled in the school and programs under its 12 jurisdiction for which the General Assembly provides 13 funds. 14 (7) Prepare and adopt or approve programs of study 15 and rules, bylaws, and regulations for the conduct of 16 students and for the government of the school and 17 programs under its jurisdiction. 18 (8) Employ such personnel as may be needed, 19 establish policies governing their employment and 20 dismissal, and fix the amount of their compensation. In 21 the employment, establishment of policies and fixing of 22 compensation the board may make no discrimination on 23 account of sex, race, creed, color or national origin. 24 The Academy, its board of trustees, and its employees 25 shall be represented and indemnified in certain civil law 26 suits in accordance with "An Act to provide for 27 representation and indemnification in certain civil law 28 suits", approved December 3, 1977, as amended. 29 Neither the Academy, nor its officers, employees or board 30 members shall participate in the creation of any corporation, 31 joint venture, partnership, association, or other 32 organizational entity which exercises, expands, or enhances 33 the powers, duties, or responsibilities of the Academy unless 34 specifically authorized by the General Assembly by law. -5- LRB9105977NTsb 1 This Section does not restrict the Academy from creating 2 any organization entity which is within or a part of the 3 Academy. 4 (Source: P.A. 86-109.) 5 Section 99.
