91_SB1142enr SB1142 Enrolled LRB9106159RCks 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 12-14.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 12-14.1 as follows: 7 (720 ILCS 5/12-14.1) 8 Sec. 12-14.1. Predatory criminal sexual assault of a 9 child. 10 (a) The accused commits predatory criminal sexual 11 assault of a child if: 12 (1) the accused was 17 years of age or over and 13 commits an act of sexual penetration with a victim who 14 was under 13 years of age when the act was committed; or 15 (2) the accused was 17 years of age or over and 16 commits an act of sexual penetration with a victim who 17 was under 13 years of age when the act was committed and 18 the accused caused great bodily harm to the victim that: 19 (A) resulted in permanent disability; or 20 (B) was life threatening; or 21 (3) the accused was 17 years of age or over and 22 commits an act of sexual penetration with a victim who 23 was under 13 years of age when the act was committed and 24 the accused delivered (by injection, inhalation, 25 ingestion, transfer of possession, or any other means) to 26 the victim without his or her consent, or by threat or 27 deception, and for other than medical purposes, any 28 controlled substance. 29 (b) Sentence. 30 (1) A person convicted of a violation of subsection 31 (a)(1) commits a Class X felony. SB1142 Enrolled -2- LRB9106159RCks 1 (1.1) A person convicted of a violation of 2 subsection (a)(2) or (a) (3) commits a Class X felony for 3 which the person shall be sentenced to a term of 4 imprisonment of not less than 50 years and not more than 5 60 years. 6 (1.2) A person convicted of predatory criminal 7 sexual assault of a child committed against 2 or more 8 persons regardless of whether the offenses occurred as 9 the result of the same act or of several related or 10 unrelated acts shall be sentenced to a term of natural 11 life imprisonment. 12 (2) A person who is convicted of a second or 13 subsequent offense of predatory criminal sexual assault 14 of a child, or who is convicted of the offense of 15 predatory criminal sexual assault of a child after having 16 previously been convicted of the offense of criminal 17 sexual assault or the offense of aggravated criminal 18 sexual assault, or who is convicted of the offense of 19 predatory criminal sexual assault of a child after having 20 previously been convicted under the laws of this State or 21 any other state of an offense that is substantially 22 equivalent to the offense of predatory criminal sexual 23 assault of a child, the offense of aggravated criminal 24 sexual assault or the offense of criminal sexual assault, 25 shall be sentenced to a term of natural life 26 imprisonment.
