91_SB1107eng SB1107 Engrossed LRB9102444JSpr 1 AN ACT to amend the Nursing Home Care Act by changing 2 Section 2-201.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Nursing Home Care Act is amended by 6 changing Section 2-201.5 as follows: 7 (210 ILCS 45/2-201.5) 8 Sec. 2-201.5. Screening prior to admission. All persons 9 age 18 or older seeking admission to a nursing facility must 10 be screened to determine the need for nursing facility 11 services prior to being admitted, regardless of income, 12 assets, or funding source. In addition, any person who seeks 13 to become eligible for medical assistance from the Medical 14 Assistance Program under the Illinois Public Aid Code to pay 15 for long term care services while residing in a facility must 16 be screened prior to receiving those benefits. Screening for 17 nursing facility services shall be administered through 18 procedures established by administrative rule. Screening may 19 be done by agencies other than the Department as established 20 by administrative rule. This Section applies on and after 21 July 1, 1996. 22 (Source: P.A. 89-21, eff. 7-1-95.) 23 Section 99. Effective date. This Act takes effect upon 24 becoming law.
